AN ACT TO AMEND SECTION 50-17-1040, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO FISHING WITH ANCHOR NETS OR SEINES IN GAME ZONE 7, SO AS TO CHANGE THE ZONE DESIGNATION TO GAME ZONE 9; TO AMEND SECTION 50-13-730, RELATING TO THE USE OF NETS TO CATCH NONGAME FISH IN GAME ZONE 9, SO AS TO E~TEND THE DATE FOR THE CLOSING OF THE OPEN SEASON FOR THE TAKING OF HERRING FROM MARCH TWENTIETH TO MARCH THIRTY-FIRST; AND TO AMEND SECTION 50-13-940, RELATING TO GILL NETS, SO AS TO ADD MARCH TO THE MONTHS DURING WHICH THEY MAY BE USED.

Be it enacted by the General Assembly of the State of South Carolina:

Unlawful to fish with anchor nets or seines in Game Zone 7

Section 1. Section 50-17-1040 of the 1976 Code is amended by striking "7" on line four and inserting "9". The section as amended shall read:

"Section 50-17-1040. It shall be unlawful or any person to fish with anchor nets or seines in the waters of Midway Inlet between Pawleys Island and Litchfield (Magnolia) Beach south to the north causeway bridge in Game Zone 9 in Georgetown County between, September first and December thirty-first of each year. Any person violating the provisions of this section shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined for a first offense not less than twenty-five dollars nor more than one hundred dollars, and for a second or subsequent offense the fine shall be one hundred dollars."

Dates for open season for taking herring in Game Zone 9

Section 2. The third paragraph of Section 50-13-730 of the 1976 Code is amended by striking on line three "March twentieth" and inserting "March thirty-first". The paragraph when amended shall read:

"Any open season established by the Commission under the authority of this section relating to the open season for the taking of herring shall be from February twentieth to March thirty-first of each year, inclusive; and no nets shall be allowed for the taking of herring with a mesh size of less than three-inch square."

Size of gill nets used in Game Zone 7 and Georgetown County

Section 3. Section 50-13-940 of the 1976 Code is amended by striking on line five "and February" and inserting ", February and March". The section when amended shall read:

"Section 50-13-940. Notwithstanding the provisions of Section 50-13-910, but subject to the closed time limitations set forth in Section 50-13-530, gill nets of a size no smaller than four and one-half inch stretch mesh may be used in Game Zone No. 7 and Georgetown County during the months of November, December, January, February and March. Provided, however, no such nets may be used in Game Zone No. 7 and Georgetown County below the forty-mile limit during the month of February."

Time effective

Section 4. This act shall take effect upon approval by the Governor.
