AN ACT TO AMEND SECTION 38-9-70, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REQUIREMENT THAT THE WHOLE CONTRACT BETWEEN INSURERS AND INSUREDS SHALL APPEAR IN THE APPLICATION AND POLICY OF INSURANCE, SO AS TO DELETE A PROVISION WHICH EXEMPTS POLICIES OF INSURANCE WRITTEN ON A WEEKLY OR MONTHLY INDUSTRIAL PLAN.

Be it enacted by the General Assembly of the State of South Carolina:

Application to be furnished with insurance policy

Section 1. Section 38-9-70 of the 1976 Code is amended by striking the last sentence. The section, as amended, shall read:

"Section 38-9-70. Every insurance company doing a life, health or accident insurance business in the State shall deliver with each policy of insurance issued by it a copy of the application made by the insured so that the whole contract shall appear in the application and policy of insurance, in default of which no defense shall be allowed to such policy on account of anything contained in, or omitted from, such application. If such a policy of insurance is issued upon an oral application, no defense shall be allowed to the policy on account of anything contained in, or omitted from, such oral application."

Time effective

Section 2. This act shall take effect July 1, 1980.
