AN ACT TO AMEND ACT 199 OF 1979, THE STATE GENERAL APPROPRIATION ACT, SO AS TO PROVIDE THAT THE CITADEL, CLEMSON UNIVERSITY, THE COLLEGE OF CHARLESTON, FRANCIS MARION COLLEGE, LANDER COLLEGE, SOUTH CAROLINA STATE COLLEGE, THE UNIVERSITY OF SOUTH CAROLINA AND WINTHROP COLLEGE SHALL BE FUNDED BY USING THE NUMBER OF FULL-TIME EQUIVALENT STUDENTS ON THE FALL DATE OF ENROLLMENT INSTEAD OF THE AVERAGE ENROLLMENT ON NOVEMBER 1,1979, AND FEBRUARY 1,1979, AND TO ELIMINATE THE TIME LIMIT FOR SUCH COLLEGES AND UNIVERSITIES TO SUBMIT A REVISED BUDGET TO THE BUDGET AND CONTROL BOARD AND THE JOINT APPROPRIATIONS RENEW COMMITTEE WHICH REFLECTS A CHANGE IN APPROPRIATED FUNDS.

Be it enacted by the General Assembly of the State of South Carolina:

Commission to certify student enrollment

Section 1. Section 18, Part I of Act 199 of 1979 is amended by striking paragraphs A and E of the proviso and inserting:

"A. The Commission on Higher Education shall certify to the Budget and Control Board the actual fall full-time equivalent student enrollment. This figure, as reported by the Commission on Higher Education, shall be utilized as the number of full-time equivalent students as used in paragraphs C and D of this proviso.

E. Upon notification by the Budget and Control Board of an adjustment to the appropriation, the institution shall submit to the Budget and Control Board and to the Joint Appropriations Review Committee a revised budget reflecting the increase or decrease in appropriated funds."

Further

Section 2. Section 19, Part I of Act 199 of 1979 is amended by striking paragraphs A and E of the second proviso and inserting:

"A. The Commission on Higher Education shall certify to the Budget and Control Board the actual fall full-time equivalent student enrollment. This figure, as reported by the Commission on Higher Education, shall be utilized as the number of full-time equivalent students as used in paragraphs C and D of this proviso.

Section 3. Section 20, Part I of Act 199 of 1979 is amended by striking paragraphs A and E of the third proviso and inserting:

"A. The Commission on Higher Education shall certify to the Budget and Control Board the actual fall full-time equivalent student enrollment. Section 4. Section 21, Part I of Act 199 of 1979 is amended by striking paragraphs A and E of the fourth proviso and inserting:

"A. The Commission on Higher Education shall certify to the Budget and Control Board the actual fall full-time equivalent student enrollment. This figure, as reported by the Commission on Higher Education, shall be utilized as the number of full-time equivalent students as used in paragraphs C and D of this proviso.

E. Upon notification by the Budget and Control Board of an adjustment to the appropriation, the institution shall submit to the Budget and Control Board and to the Joint Appropriations Review Committee a revised budget reflecting the increase or decrease in appropriated funds."

Section 5. Section 22, Part I of Act 199 of 1979 is amended by striking paragraphs A and E of the third proviso and inserting:

"A. The Commission on Higher Education shall certify to the Budget and Control Board the actual fall full-time equivalent student enrollment. This figure, as reported by the Commission on Higher Education, shall be utilized as the number of full-time equivalent students as used in paragraphs C and D of this proviso.

E. Upon notification by the Budget and Control Board of an adjustment to the appropriation, the institution shall submit to the Budget and Control Board and to the Joint Appropriations Review Committee a revised budget reflecting the increase or decrease in appropriated funds."

Further

Section 6. Section 23, Part I of Act 199 of 1979 is amended by striking paragraphs A and E of the second proviso and inserting:

"A. The Commission on Higher Education shall certify to the Budget and Control Board the actual fall full-time equivalent student enrollment. This figure, as reported by the Commission on Higher Education, shall be utilized as the number of full-time equivalent students as used in paragraphs C and D of this proviso.

Committee a revised budget reflecting the increase or decrease in appropriated funds."

Further

Section 7. Section 24, Part I of Act 199 of 1979 is amended by striking paragraphs A and E of the seventh proviso and inserting:

"A. The Commission on Higher Education shall certify to the

Budget and Control Board the actual fall full-time equivalent student enrollment. This figure, as reported by the Commission on Higher Education, shall be utilized as the number of full-time equivalent students as used in paragraphs C and D of this proviso.

E. Upon notification by the Budget and Control Board of an adjustment to the appropriation, the institution shall submit to the Budget and Control Board and to the Joint Appropriations Review Committee a revised budget reflecting the increase or decrease in appropriated funds."

Further

Section 8. Section 25, Part I of Act 199 of 1979 is amended by striking paragraphs A and E of the fourth proviso and inserting

"A. The Commission on Higher Education shall certify to the Budget and Control Board the actual fall full-time equivalent student enrollment. This figure, as reported by the Commission on Higher Education, shall be utilized as the number of full-time equivalent students as used in paragraphs C and D of this proviso.

E. Upon notification by the Budget and Control Board of an adjustment to the appropriation, the institution shall submit to the Budget and Control Board and to the Joint Appropriations Review Committee a revised budget reflecting the increase or decrease in appropriated funds."

Appropriations shall not be reduced

Section 9. Notwithstanding the written provisions contained in Sections 18 through 25 inclusive of Act 199 of 1979 pertaining to the procedures and formula to be used in adjusting the amounts appropriated to the various institutions covered in those sections, the appropriations authorized in Sections 18 through 25 inclusive of Act 199 of 1979 shall not be reduced.

Time effective

Section 10. This act shall take effect upon approval by the Governor.
