AN ACT TO AMEND SECTION 33-31-40, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO APPROVAL AND ENDORSEMENT OF DECLARATIONS FILED BY NON-PROFIT ORGANIZATIONS, SO AS TO ELIMINATE THE REQUIREMENT FOR APPROVAL BY THE CLERK OF COURT, PROBATE JUDGE, COUNTY TREASURER AND COUNTY AUDITOR AND THE REQUIREMENT FOR ENDORSEMENTS BY FREEHOLD ELECTORS.

Be it enacted by the General Assembly of the State of South Carolina:

Sheriff to approve declaration

Section 1. Section 33-31-40 of the 1976 Code is amended to read:

"Section 33-31-40. Such declaration shall be approved by the sheriff in the county in which the association proposes to have its principal place of business. But the provisions of this section requiring declarations to be approved by the sheriff shall not apply to applications for charters for religious or eleemosynary institutions."

Time effective

Section 2. this act shall take effect upon approval by the Governor.
