AN ACT TO AMEND SECTION 41-15-320, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PENALTIES FOR VIOLATION OF OCCUPATIONAL HEALTH AND SAFETY STANDARDS, SO AS TO PROVIDE THE COMMISSIONER OF LABOR OR HIS AGENTS DISCRETION IN DETERMINING WHETHER TO ASSESS A CIVIL PENALTY FOR A SERIOUS VIOLATION OF STANDARDS OR REGULATIONS AND DISCRETION IN DETERMINING WHETHER TO ASSESS A CIVIL PENALTY FOR A VIOLATION OF THE POSTING REQUIREMENTS.
Be it enacted by the General Assembly of the State of South Carolina:
Penalty
Section 1. Subsection (b) of Section 41-15-320 of the 1976 Code
is amended by striking on line three "shall" and inserting "may"
so that as amended it shall read:
"(b) Any employer who has received a citation for a serious violation of an occupational safety or health rule or regulation promulgated pursuant to this article may be assessed a civil penalty of up to one thousand dollars for each such violation."
Penalty
Section 2. Subsection (f) of Section 41-15-320 of the 1976 Code is amended by striking on line two "shall" and inserting "may" so that as amended it shall read:
"(f) Any employer who violates any of the posting requirements, as prescribed under the provisions of this article, may be assessed a civil penalty of up to one thousand dollars for each violation."
Time effective
Section 3. This act shall take effect upon approval by the Governor.
