AN ACT TO AMEND SECTION 50-19-2340, CODE OF LAWS OF SOUTH CAROLINA, 1976, AS AMENDED, RELATING TO DEVICES USED FOR TAKING NONGAME FISH IN LAKE GREENWOOD AND BOYD'S MILL, SO AS TO LIMIT THE NUMBER OF PLASTIC JUGS WHICH MAY BE USED BY ANY ONE PERSON, TO REQUIRE A PERMIT TO USE JUGS AND TO ELIMINATE THE REQUIREMENT THAT THEY BE SECURED TO REMAIN STATIONARY.

Be it enacted by the General Assembly of the State of South Carolina:

Taking of nongame fish in Lake Greenwood

Section 1. Section 50-19-2340, of the 1976 Code, as last amended by Act 545 of 1978, is further amended to read:

"Section 50-19-2340. Trotlines, baskets or plastic jugs may be used in the waters of Lake Greenwood and its immediate tributaries and Boyd's Mill for the taking of nongame fish provided the trotlines or jugs are baited only with cut bait or dough balls, 'cut bait' being defined as not being over one-fourth of a fish or minnow, if fish or minnows are used but not excluding any other meat to be used as cut bait. Each person may use not more than three trotlines and baskets if a tag issued by the Department is securely attached to each trotline or basket, such tags to cost twenty-five cents each. No person may use more than fifty plastic jugs and for each five jugs used shall purchase from the Department a tag which shall be securely attached to one jug in each five jug set. The cost of each tag shall be twenty-five cents. Baskets must be of a design specified by the Department and no trotline may have more than fifty hooks. Any person violating the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction shall be fined not less than fifty dollars nor more than one hundred dollars."

Section 2. This act shall take effect upon approval by the Governor.
