AN ACT TO AMEND ACT 291 OF 1979, RELATING TO THE ORANGEBURG COUNTY PUBLIC SCHOOL SYSTEM AND THE SCHOOL DISTRICT EQUALIZATION FUND, SO AS TO FURTHER PROVIDE FOR SCHOOL DISTRICT BUDGETS AND THE LEVY AND COLLECTION OF SCHOOL TAXES FOR THE OPERATION OF PUBLIC SCHOOLS OF THE COUNTY AND THE CREATION AND DISBURSEMENT OF THE COUNTY EQUALIZATION FUND; AND TO REPEAL A PROVISION OF LAW (DESIGNATED SECTION 21-3714 IN THE 1962 CODE) RELATING TO SCHOOL BUDGETS AND SCHOOL TAXES IN ORANGEBURG COUNTY.

Be it enacted by the General Assembly of the State of South Carolina:

Board of Trustees to submit proposed budget to county board

Section 1. Section 4 of Act 291 of 1979 is amended to read:

"Section 4. (a) Annually, at such time as may be required by the county board of education, but not later than April thirtieth, each school district board of trustees shall submit to the county board a proposed budget for the ensuing school year, which shall be subject to approval by the county board. Upon the board's approval of the budget, the board shall notify the county auditor of the amount to be raised by taxation to operate the schools in the district for the year and the amount of the district's obligation to participate in the county equalization program as prescribed in subsections (b) and (c) of this section. The county auditor shall thereupon levy and the county treasurer collect a tax upon the taxable property of the district sufficient to raise the needed amount.

(b) The treasurer shall deposit in a special account an amount equal to eight mills of the amount of tax monies collected for each school district in the county for the tax year 1980, sixteen mills for the tax year 1981 and twenty-five mills for the tax year 1982 and each year thereafter. The proceeds of the monies deposited in the special account each year shall be dispersed to each school district in the county on a per pupil basis based on the one hundred thirty-five day weighted pupil count for the previous year. It is the intent of this section to provide for a supplemental equalization program for funding operation of the county public school system.

(c) No part of the funds dispersed from the special fund created in this section shall be included in the computation of the local tax effort of districts used to determine entitled funds for the district under the State Education Finance Act."

Repeal

Section 2. The provision of law (designated Section 21-3714 in the 1962 Code) originally enacted as the last paragraph of Section 3 of Act 256 of 1951 is repealed.

Time effective

Section 3. This act shall take effect upon approval by the Governor.
