AN ACT TO AMEND SECTION 40-37-310, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PENALTIES INVOLVED IN THE UNLAWFUL PRACTICE OF OPTOMETRY, SO AS TO INCREASE PENALTIES IN CERTAIN CASES AND TO ELIMINATE PAYMENT OF FINES TO SPECIAL PARTIES.

Be it enacted by the General Assembly of the State of South Carolina:

Penalties

Section 1. Section 40-37-310 of the Code of is amended to read:

"Section 40-37-310. It shall be unlawful for any person to practice optometry within the meaning of this chapter in violation of the provisions hereof and any person committing such a violation shall, upon conviction, be fined not more than one thousand dollars or imprisoned not more than two years, or both, in the discretion of the court. Each violation shall constitute a separate offense. The penalties provided in this section shall apply to corporation, association or person aiding and abetting in a violation.

Any person violating any other of the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction in a court of competent jurisdiction, be punished by a fine of not less than twenty-five dollars and not exceeding one hundred dollars or by imprisonment for not less than twenty days and not exceeding thirty days."

Time Effective

Section 2. This act shall take effect upon approval by the Governor.
