AN ACT TO AMEND SECTIONS 38-35-440 AND 38-35-460, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO REQUIRED AND OPTIONAL PROVISIONS OF ACCIDENT AND HEALTH INSURANCE POLICIES, SO AS TO DELETE THE ITEM WHICH DEALS WITH CONFORMING POLICY PROVISIONS WITH THE STATUTES OF THE STATE IN WHICH THE INSURED RESIDES FROM SECTION 38-35-460 AND INSERTING SUCH ITEM IN SECTION 38-35-440.

Be it enacted by the General Assembly of the State of South Carolina:

Deletion of conforming policy provision

Section 1. Section 38-35-460 of the 1976 Code is amended by striking item (8) which reads:

"(8) A provision as follows:

CONFORMITY WITH STATE STATUTES: Any provision of this policy which, on its effective date, is in conflict with the statutes of the state in which the insured resides on such date is hereby amended to conform to the minimum requirements of such statutes."

Further

Section 2. Section 38-35-440 of the 1976 Code is amended by adding at the end:

"(13) A provision as follows:

CONFORMITY WITH STATE STATUTES: Any provision of this policy which, on its effective date, is in conflict with the statutes of the state in which the insured resides on such date is hereby amended to conform to the minimum requirements of such statutes."

Time effective

Section 3. This act shall take effect July 1, 1981.
