AN ACT TO AMEND SECTIONS 44-43-30 AND 44-43-40, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO GIFTS OF ALL OR PARTS OF A DECEASED PERSON'S BODY, SO AS TO DIRECT THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION TO FURNISH EVERY PERSON, WHO APPLIES FOR THE ISSUANCE, REISSUANCE OR RENEWAL OF A DRIVER'S LICENSE, A DOCUMENT CONTAINING A SUMMARY DESCRIPTION AND EXPLANATION OF THE UNIFORM ANATOMICAL GIFT ACT, ALONG WITH A FORM FOR DONATING TISSUES AND ORGANS UNDER THE ACT, AND PROVIDE A SUITABLE DECAL TO BE ATTACHED TO THE DRIVER'S LICENSE OF ALL PERSONS WHO HAVE FURNISHED NOTICE TO THE DEPARTMENT THAT THEY ARE DONORS UNDER THE ACT.

Be it enacted by the General Assembly of the State of South Carolina:

Department to furnish document

Section 1. Section 44-43-30 of the 1976 Code is amended by adding before the period at the end of the first sentence "and a document containing a summary description and explanation of such act." The section when amended shall read:

"Section 44-43-30. Whenever any person applies for the issuance, reissuance or renewal of any class of driver's license, the Department of Highways and Public Transportation is authorized to furnish that person with a form, sufficient under the provisions of the Uniform Anatomical Gift Act (Article 5 of this chapter), for the gift of all or part of the donor's body conditioned upon the donor's death and a document containing a summary description and explanation of such act. If any such person who is legally authorized desires to execute such a gift, the Department may provide that person with appropriate assistance and the presence of the legally required number of witnesses."

Decal-Execution of gift

Section 2. Section 44-43-40 of the 1976 Code is amended by striking the first sentence and inserting "The Department of Highways and Public Transportation shall issue to each person who has notified it that he is a donor under the Uniform Anatomical Gift Act a suitable decal to be affixed to the driver's license of such person. Such notice shall be an affidavit executed on a form prepared by the Department and furnished on written request." The section amended shall read:

"Section 44-43-40. The Department of Highways and Public Transportation shall issue to each person who has notified it that he is a donor under the Uniform Anatomical Gift Act a suitable decal to be affixed to the driver's license of such person. Such notice shall be an affidavit executed on a form prepared by the Department and furnished on written request. Such notation shall not constitute execution of a gift under the Uniform Anatomical Gift Act. The Department of Highways and Public Transportation shall not be the registry of anatomical gifts and shall not make and keep records of notation of any anatomical gift on or accompanying a driver's license issued by the Department."

Time Effective

Section 3. This act shall take effect upon approval by the Governor.
