AN ACT TO AMEND SECTION 12-31-220, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO HIGHWAY REGISTRATION CARDS AND IDENTIFICATION MARKERS, SO AS TO PROVIDE FOR A TEMPORARY PERMIT TO BE ISSUED UNDER CERTAIN CIRCUMSTANCES AND TO PROVIDE FOR THE TAX COMMISSION TO AUTHORIZE CERTAIN PERSONS TO SELL AND ISSUE PERMITS.

Be it enacted by the General Assembly of the State of South Carolina:

Motor carriers to obtain temporary permit

Section 1. Section 12-31-220 of the 1976 Code is amended to read:

"Section 12-31-220. Any motor carrier having infrequent trips into and through the State may obtain a temporary permit which shall be good for one motor vehicle for a period of ten consecutive days beginning and ending on the dates specified on the face of the permit. The fee for the permit shall be fifteen dollars and no reports shall be required of such motor carriers. Temporary permits shall be issued in lieu of annual registration required under this chapter and highway use taxes incurred during this period. The temporary permit shall be carried in the vehicle for which it was issued at all times when the vehicle is in this State. The commission may issue a temporary permit by facsimile message, letter or telegram.

The commission may engage any person to sell and issue the temporary permits provided the person purchases such permits from the commission. No person shall be allowed to sell and issue the permits unless the permits are available to the public on a twenty-four hour basis.

The commission shall promulgate the necessary regulations for the proper administration of this section.

The permit fee provided by this section shall be distributed as follows: (a) four-fifths to the State Highway Fund and (b) one-fifth to the Motor Transportation Fund authorized pursuant to Section 58-23-630 and shall be distributed to the incorporated cities and towns of the State in the same manner as provided by Section 58-23-630."

Section 2. This act shall take effect upon approval by the

Governor.
