AN ACT TO AMEND SECTIONS 44-53-930 AND 44-53-940, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO RETAIL SALES AND DELIVERY OF HYPODERMIC NEEDLES AND SYRINGES, SO AS TO PROVIDE THAT SYRINGES AND HYPODERMIC NEEDLES MAY BE SOLD AND DELIVERED BY PERSONS LAWFULLY SELLING VETERINARY MEDICINES IF THEY ARE REGISTERED AND PAY THE PRESCRIBED REGISTRATION FEE.

Be it enacted by the General Assembly of the State of South Carolina:

Sales of hypodermic needles

Section 1. Section 44-53-930 of the 1976 Code is amended to read:

"Section 44-53-930. Sales at retail of hypodermic needles or syringes shall be made only by a registered pharmacist or registered assistant pharmacist through a permitted pharmacy as authorized by Section 40-43-370, except that syringes and hypodermic needles may be sold by persons lawfully selling veterinary medicines as authorized by item (8) of Section 40-69-220 if they register annually with the Department of Health and Environmental Control and pay such registration fee as may be required By the Department and they shall be subject to the provisions of Section 44-53-920."

Veterinarians may purchase syringes--conditions

Section 2. Subsection (a) of Section 44-53-940 of the 1976 Code is amended to read:

"(a) Persons authorized by Section 44-53-930 making sales to persons who are personally known by them and who are known to have a legitimate medical or veterinary medicine use for such syringes or needles and who deliver such syringes or needles to the domicile of the buyer are not required to obtain the signature of the buyer provided that the name of the person shall be inserted in the record of sale and initiated by the person authorized by Section 44-53-930 approving the sale."

Time effective

Section 3. This act shall take effect upon approval by the Governor.
