AN ACT TO AMEND SECTION 56-3-2320, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEALER DEMONSTRATION LICENSE PLATES AND RESTRICTIONS ON THEIR USE, SO AS TO PERMIT SUCH PLATES TO BE USED FOR TRUCK DEMONSTRATIONS NOT TO EXCEED THREE DAYS WHERE MERCHANDISE OR CARGO IS CARRIED AND TO PROVIDE FOR THE ISSUANCE, CONTENT, MAINTENANCE AND TRANSMITTAL OF SPECIAL DEMONSTRATION CERTIFICATES AUTHORIZING SUCH USE.

Be it enacted by the General Assembly of the State of South Carolina:

Dealer demonstration license plates

Section 1. Section 56-3-2320 of the 1976 Code is amended by adding at the end:

"For purposes of this section, the testing or demonstration of a truck as defined in Section 56-3-20(10) shall include permitting a prospective buyer to use such truck for carrying merchandise or cargo for a period not to exceed three days upon the dealer providing the buyer with a special demonstration certificate for this purpose. The form and content of such demonstration certificate shall be as prescribed by regulation of the Department which shall also provide such certificates to dealers upon their request. The original certificate shall be kept by the buyer in the cab of the truck during the three day demonstration period and the dealer shall retain a copy of the certificate and shall also mail a copy of the certificate to the Department within twenty-four hours after it is issued to the buyer." The section when amended shall read:

"Section 56-3-2320. The Department may issue to a duly licensed motor vehicle dealer, upon application being made therefor and the required fee being paid to the Department as provided in this chapter, dealer demonstration license plates. Such license plates, notwithstanding any provision of this chapter to the contrary, shall be used by the dealer purchasing them exclusively on vehicles owned by such dealer which are being offered for sale or which are being used as demonstrators of vehicles of like makes offered for sale. Dealer demonstration plates may not be used on service or work vehicles of such dealer nor on vehicles owned by such dealer which are kept primarily for personal use of the dealer or any officer or employee of the dealer or of any of their families. Also, dealer demonstrator plates may not be used on commercial vehicles except in transporting, testing or demonstrating such commercial vehicles.

Time effective

Section 2. This act shall take effect upon approval by the Governor.
