AN ACT TO AMEND SECTION 44-11-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ADMISSION OF PATIENTS TO A FACILITY UNDER THE JURISDICTION OF THE DEPARTMENT OF MENTAL HEALTH LOCATED AT THE STATE PENITENTIARY, SO AS TO CORRECT AN ERRONEOUS CODE REFERENCE AND TO INCLUDE OTHER SECTIONS RELATING THERETO.

Be it enacted by the General Assembly of the State of South Carolina:

Commission may designate certain buildings

Section 1. Section 44-11-20 of the 1976 Code is amended by striking "at the State Penitentiary" on lines three and four and inserting "within the State Department of Corrections" and by striking "Section 44-17-610" on line eight and inserting "Section 44-23-410, 44-23-430 or 44-23-610". The section when amended shall read:

"Section 44-11-20. The Mental Health Commission may, in mutual agreement with the authorities of the South Carolina Department of Corrections, designate any building or portion thereof within the State Department of Corrections as a facility of the South Carolina Department of Mental Health, and may, whenever, in its opinion, such would contribute to the patient's safety, care or treatment or to the safety, care or treatment of other patients, transfer to such building or parts thereof any patient admitted under Section 44-23~ 410, 44-23-430 or 44-23-610. The Department of Mental Health shall have primary responsibility for the medical and psychiatric care and treatment of such patients, but the Department of Corrections shall have primary responsibility for the maintenance and security of all such patients."

Section 2. This act shall take effect upon approval by the Governor.
