AN ACT TO REVISE THE DATES FOR ELECTION OF MEMBERS OF THE BOARD OF TRUSTEES OF THE SCHOOL DISTRICT OF GREENVILLE COUNTY; TO EXTEND THE TERMS OF THE PRESENT TRUSTEES; TO PROVIDE THAT MEMBERS OF THE BOARD SHALL BE ELECTED IN NONPARTISAN ELECTIONS IN THE GENERAL ELECTION COMMENCING IN 1982; TO PROVIDE THAT THE TERM OF OFFICE OF EACH TRUSTEE SHALL BE FOUR YEARS TO COMMENCE ON THE FIRST DAY OF JANUARY NEXT FOLLOWING ELECTION; TO PROVIDE FOR THE METHOD OF DETERMINING THE WINNER OF SUCH ELECTION; TO PROVIDE FOR THE MANNER OF QUALIFYING AS A CANDIDATE; TO PROVIDE FOR THE MANNER OF CONDUCTING AND SUPERVISING ALL ELECTIONS FOR MEMBERS OF THE BOARD; AND TO REPEAL ACT 243 OF 1981, RELATING TO THE ELECTION OF MEMBERS OF THE BOARD.

Be it enacted by the General Assembly of the State of South Carolina:

Members to be elected in nonpartisan election

Section 1. Notwithstanding any other provision of law, members of the Board of Trustees of the School District of Greenville County shall be elected in nonpartisan elections in the general election commencing in 1982. The term of office of any present trustee whose term expires prior to the general election of 1982 is extended until his successor is elected of 1982 and prior to the general election of 1984 or after the general election of 1984 and prior to the general election of 1986 is extended until his successor is elected in the appropriate general election and qualifies for office.

The term of office of each trustee shall be four years to commence on the first day of January next following the election.

At any election, the candidate in each area receiving the highest number of votes cast shall be elected. All members of the board shall serve until their successors have been elected and qualify.

To qualify as a candidate in any election to be held for members of the board, each candidate shall file with the Registration and Election Office of Greenville County a sworn statement giving his name, age, voting precinct, school election area in which such candidate is a legal resident, and the period of residence in such school election area. This statement shall be filed not later than fifty days prior to the date set for such election and not earlier than sixty days prior to election day.

The county commissioners of election shall conduct and supervise all elections for members of the board. The commissioners shall prepare the necessary ballots, appoint managers for the voting precincts, and do all things necessary to carry out such elections, including the counting of ballots and declaring the results thereof. The commissioners shall advertise the date of such election sixty days preceding the election in all daily newspapers of general circulation published in Greenville County and publish a second notice two weeks later.

Repeal

Section 2. Act 243 of 1981 is repealed.

Section 3. This act shall take effect upon the approval by the Governor.
