AN ACT TO AMEND SECTION 38-3-150, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CONDUCT OF EXAMINATIONS, INVESTIGATIONS AND HEARINGS BY THE CHIEF INSURANCE COMMISSIONER, SO AS TO PERMIT THE COMMISSIONER TO AUTHORIZE HIS ASSISTANTS AND AGENTS IN ADDITION TO THE DEPUTY COMMISSIONER TO CONDUCT HEARINGS, EXCEPT THAT HEARINGS CONCERNING ADJUSTMENTS OF RATES SHALL BE CONDUCTED BY THE CHIEF INSURANCE COMMISSIONER OR THE DEPUTY COMMISSIONER.

Be it enacted by the General Assembly of the State of South Carolina:

Hearings conducted by commissioner

SECTION 1. Section 38-3-150 of the 1976 Code is amended to read:

"Section 38-3-150. All examinations or investigations provided by this Title, unless otherwise provided by any other insurance laws of this State, may be conducted by the Commissioner personally or by one or more of his duly authorized assistants or agents. All hearings

shall be held by the Commissioner or by one of his duly authorized assistants or agents when authorized to do so in writing by the Chief Insurance Commissioner; provided, however, that in any hearing concerning the adjustment of insurance rates only the Chief Commissioner or the Deputy Commissioner shall conduct the hearing.

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
