AN ACT TO AMEND CHAPTER 23 OF TITLE 48, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO FORESTRY, BY ADDING SECTION 48-23-95 SO AS TO PROVIDE THAT THE STATE COMMISSION OF FORESTRY PRESCRIBE AND PREPARE A SPECIAL OFFICIAL SUMMONS FORM TO BE USED BY THE COMMISSION'S FOREST LAW ENFORCEMENT OFFICERS IN MAKING ARRESTS FOR OFFENSES WHERE THE MAXIMUM PENALTY DOES NOT EXCEED A FINE OF TWO HUNDRED DOLLARS OR THIRTY DAYS IMPRISONMENT.

Be it enacted by the General Assembly of the State of South Carolina:

Official summons form to be used

Section 1. Chapter 23 of Title 48 of the 1976 Code is amended by adding:

"Section 48-23-95. The State Commission of Forestry shall prescribe and prepare a special official summons form to be used exclusively by its forest law enforcement officers in making arrests for offenses punishable by fines not to exceed two hundred dollars or imprisonment not exceed thirty days.

Any person charged with such offenses shall, upon service of the commission summons by a forest law enforcement officer, appear in the court therein named at the time and place designated and such service shall vest in the court jurisdiction to hear and dispose of the charge for which the summons was issued."

Time effective

Section 2. This act shall take effect upon the approval by the Governor.
