AN ACT TO AMEND SECTION 17-7-170, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE POWER OF CORONERS TO ISSUE WARRANTS AND TO SUMMON AND EXAMINE WITNESSES, SO AS TO REQUIRE A CORONER TO SERVE A NOTICE OF HEARING ON ANY PERSON WHO HAS BEEN SERVED WITH AN ARREST WARRANT FOR CAUSING THE DEATH OF THE DECEASED PERSON WHOSE INQUEST IS TO BE CONDUCTED.

Be it enacted by the General Assembly of the State of South Carolina:

Coroner to serve notice of hearing

SECTION 1. Section 17-7-170 of the 1976 Code is amended by adding at the end:

"He shall serve a notice of hearing on any person who has been served with an arrest warrant charging him with causing the death of the subject of the inquest. The notice of hearing shall be served at least four days prior to the inquest." When amended the section shall read:

"Section 17-7-170. The coroner may issue warrants, summon witnesses and examine before the jury any person present, whether summoned or not, concerning the death. He shall serve a notice of hearing on any person who has been served with an arrest warrant charging him with causing the death of the subject of the inquest. The notice of hearing shall be served at least four days prior to the inquest."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
