A JOINT RESOLUTION TO AMEND SECTION 186 OF PART I OF ACT 517 OF 1980 (GENERAL APPROPRIATIONS ACT) RELATING TO THE AUTHORIZED NUMBER OF PERSONNEL EMPLOYED BY THE STATE, SO AS TO PROVIDE THAT THE DEPARTMENT OF CORRECTIONS MAY TRANSFER UP TO ONE MILLON FOUR HUNDRED SIXTY-SEVEN THOUSAND SEVEN HUNDRED FOURTEEN DOLLARS OF UNUSED FUNDS APPROPRIATED FOR NEW POSITIONS TO BE USED FOR OPERATING EXPENSES.

Be it enacted by the General Assembly of the State of South Carolina:

Department authorized to transfer money

SECTION 1. Item 5 of Section 186, Part I of Act 517 of 1980, is amended to read:

"5. That, notwithstanding any other provision of this act, state funds appropriated for new positions in this act shall be used to fund those positions only. Any funds not used for this specific purpose shall be returned to the general fund; provided, however, that the Department of Corrections is authorized to transfer up to one million four hundred sixty-seven thousand seven hundred fourteen dollars of such unused funds to be used for 'other operating expenses' under Program II, Housing, Care, Security and Supervision as the department may determine; provided, further, that each state agency with new positions funded in this act shall file a report with the Joint Legislative Committee on Personal Service Financing and Budgeting and the State Auditor by July 15, ACN:, indicating the date the new position was established, the date filled, the annual salary and the amount expended during the fiscal year for salary and fringe benefits."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
