AN ACT TO AMEND SECTION 50-3-410, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ARRESTS BY CONSERVATION OFFICERS, SO AS TO INCREASE THE LIMITATION ON THE SUM OF MONEY WHICH MAY BE DEPOSITED AS BAIL FROM ONE HUNDRED TO TWO HUNDRED DOLLARS.

Be it enacted by the General Assembly of the State of South Carolina:

Persons arrested may post bail

Section 1. Section 50-3-410 of the 1976 Code is amended to read:

"Section 50-3-410. When any person is apprehended by a game warden upon a charge of violating any fish or game laws the enforcement of which by a game warden is authorized by law, the person so being charged, upon being served with the official summons issued by the arresting game warden, in lieu of being immediately brought before the proper magistrate recorder or other judicial officer to enter into a formal recognizance or make direct the deposit of a proper sum of money in lieu of a recognizance or incarceration, may deposit with the apprehending game warden a sum of money as bail, not less than the minimum nor more than maximum fine, but in no case to exceed two hundred dollars to be in due course turned over to the judicial officers as money for bail, in lieu of entering into a recognizance for his appearance for trial as set out in the summons or being incarcerated by the arresting officer and held for further action by the appropriate judicial officer. A receipt of the sum so deposited shall be given to the person by the game warden. The summons duly served shall give the judicial officer jurisdiction to dispose of the matter. Upon receipt of the fixed sum of money the game warden may release the person so charged so that he may appear before the proper judicial officer at a time stated in and required by the summons."

Time effective

Section 2. This act shall take effect upon approval by the Governor.
