AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-2525 SO AS TO PROVIDE THAT A TOWING COMPANY WHICH TOWS ANOTHER'S MOTOR VEHICLE AWAY AND STORES IT SHALL NOTIFY THE POLICE DEPARTMENT, IF THE VEHICLE WAS PARKED WITHIN THE LIMITS OF A MUNICIPAL CORPORATION, OR THE SHERIFF OR COUNTY POLICE DEPARTMENT, IF THE VEHICLE WAS PARKED WITHOUT THE LIMITS OF A MUNICIPAL CORPORATION, TO PROVIDE FOR THE POSTING OF THE PROVISIONS OF THE SECTION ON THE PREMISES OF THE TOWING COMPANY AND PROVIDE A PENALTY.

Be it enacted by the General Assembly of the State of South Carolina:

Towing company to notify police

Section 1. The 1976 Code is amended by adding:

"Section 56-5-2525. Any towing company which tows away another's motor vehicle without the owner's knowledge and stores it shall immediately notify the police department of the municipal corporation where such vehicle was parked or the sheriff or county police department in counties having such departments if the vehicle was parked outside the limits of a municipal corporation of the location from which the vehicle was towed, the name of the company which towed it and the place where it is stored.

Any towing company failing to give such notice within one hour of the time the vehicle was towed away shall not be entitled to any compensation for the towing and storing operations. The provisions of this section shall be posted in a conspicuous place in all public areas on the premises of the towing company."

Time effective

Section 2. This act shall take effect upon approval by the Governor.
