AN ACT TO AMEND SECTION 6-7-740, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LOCAL BOARDS OF ZONING APPEALS AND ADJUSTMENT, SO AS TO PROVIDE AUTHORITY TO SUCH BOARDS TO HEAR AND DECIDE SPECIAL EXCEPTIONS TO THE TERMS OF ZONING ORDINANCES OR TO DESIGNATE ANOTHER BODY TO HEAR AND DECIDE SUCH SPECIAL EXCEPTIONS.

Be it enacted by the General Assembly of the State of South Carolina:

Boards may hear and decide exceptions

Section 1. Section 6-7-740 of the 1976 Code is amended by adding after item (2) and before the last two paragraphs of the section, the following item:

"(3) To hear and decide special exceptions subject to the terms of any ordinance upon which such board is required to pass under the terms of such ordinance; provided, that the governing authority may be ordinance designate itself or another body as the proper body to hear and decide special exceptions."

Time effective

Section 2. This act shall take effect upon approval by the Governor.
