AN ACT TO AMEND SECTIONS 44-53-190, 44-53-210 AND 44-53-250, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO NARCOTICS AND OTHER CONTROLLED SUBSTANCES, SO AS TO CONTROL CERTAIN SUBSTANCES AND CERTAIN DOSAGES OF SUBSTANCES, AND TO DECONTROL CERTAIN OTHER SUBSTANCES.

Be it enacted by the General Assembly of the State of South Carolina:

Controlled substances

Section 1. Section 44-53-190 of the 1976 Code, as last amended by Act 452 of 1978, is further amended by adding at the end of subsection (b)

"45. Sufentanil

46. Tilidine"

Section 2. Section 44-53-210 of the 1976 Code, as last amended by Act 388 of 1980, is further amended by adding at the end of subsection (c):

"23. Dextropropoxyphene [alpha-(+)-4-dimethylamino-1, 2-diphenyl-3-methyl-2-propionoxybutane], in bulk form."

Section 3. Section 44-53-250 of the 1976 Code, as last amended by Act 118 of 1979, is further amended by adding to subsection (b) "(4) Pipradol" and "(5) SPA[(-)-1-dimethylamino-1, 2-diphenylethane]"; and by deleting item (1) of subsection (d) and leaving the item blank; and further adding to subsection (e) "(2) dosage forms of Dextropropoxyphene [alpha-(+)-4-Dimethylamino-1, 2-diphenyl-3-methyl-2-propionoxybutane]."

As amended, subsections (b), (d) and (e) shall read:

"(b) Stimulants. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers (whether position, geometric, or optical), and salts of such isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation:

(1) Diethylpropion

(2) Phentermine

(3) Pemoline, including organometallic complexes and chelates thereof.

(4) Pipradol

(5) SPA [(-)-1-dimethylamino-1, 2-diphenylethane]"

"(d) Unless specifically excepted or unless listed in another schedule, any material, compound, mixture or preparation which contains any quantity of the following substances, including its salts;

(1) [Blank]"

"(e) Unless specifically excepted or unless listed in another schedule, any material, compound, mixture or preparation containing limited quantities of any of the following narcotic drugs, or salts thereof:

(1) Not more than one milligram of difenoxin and not less than twenty-five micrograms of atropine sulfate per dosage unit.

(2) Dosage forms of Dextropropoxyphene [Alpha-(+)-4-dimethylamino-1, 2-diphenyl-3-methyl-2-propionoxybutane]."

Time effective

Section 4. This act shall take effect upon approval by the Governor.
