AN ACT TO AMEND SECTION 24-1-250, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE AUTHORIZATION OF THE STATE BOARD OF CORRECTIONS TO SELL TIMBER AND THE USE OF THE PROCEEDS FROM SUCH SALE, SO AS TO DELETE THE REQUIREMENT THAT THE PROCEEDS FROM SUCH SALE BE CREDITED TO THE DEPARTMENT TO BE USED FOR CAPITAL IMPROVEMENTS AND AUTHORIZE THE DEPARTMENT TO RETAIN SUCH FUNDS TO BE UTILIZED TO MAINTAIN AND EXPAND ITS AGRICULTURAL PROGRAMS; AND TO AMEND SECTION 24-3-410, AS AMENDED, RELATING TO THE SALE OF PRISON-MADE PRODUCTS ON THE OPEN MARKET, SO AS TO PROVIDE THAT THE PROCEEDS ON THE OPEN MARKET, SO AS TO PROVIDE THAT THE PROCEEDS OF THE SALE OF ALL AGRICULTURAL PRODUCTS PRODUCED BY AN INSTRUMENTALITY UNDER THE CONTROL OF THE STATE BOARD OF CORRECTIONS SHALL BE APPLIED AS PROVIDED IN SECTION 24-1-250.
Be it enacted by the General Assembly of the State of South Carolina:
Department of Corrections authorized to sell timber
Section 1. Section 24-1-250 of the 1976 Code, as last amended by Act 148 of 1981, is further amended to read:
"Section 24-1-250. The State Board of Corrections is hereby authorized to sell mature trees and other timber suitable for commercial purposes from lands owned by the Department of Corrections. However, the proceeds derived from these sales shall not exceed fifty thousand dollars in any one year. Prior to such sales, the Board shall consult with the State Forester to determine the economic feasibility of and obtain approval for such sales. Funds derived from timber sales shall be utilized by the Department of Corrections to maintain and expand the agricultural program subject to the approval of the Budget Control Board."
Penalty
Section 2. The last paragraph of Section 24-3-410 of the 1976 Code, as amended by Act 56 of 1981, is further amended to read:
"Any person violating the provisions of this section shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a fine not less than two hundred dollars, nor more than five thousand dollars, or by imprisonment in jail not less than three months nor more than one year, or both. Each such sale or offer for sale shall constitute a separate offense under this section. Proceeds of the sale of all agricultural products, when produced by an instrumentality under control of the State Board of Corrections, shall be applied as provided in Section 24-1-250."
Time effective
Section 3. This act shall take effect upon the approval by the Governor.
