AN ACT TO AMEND SECTIONS 46-19-110 AND 4~19-130, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO COUNTY AND CITY FARM MARKETING CENTERS, SO AS TO AUTHORIZE ESTABLISHMENT OF FARM MARKETING CENTERS BY COMBINATIONS OF COUNTIES AND MUNICIPALITIES AND ALLOW THE LEASE OF SUCH CENTERS TO OTHER PERSONS FOR OPERATION, AND TO DELETE POPULATION LIMITATIONS ON ESTABLISHMENT AND PERMIT RECEIPT AND ADMINISTRATION OF FEDERAL GRANTS.

Be it enacted by the General Assembly of the State of South Carolina:

County and city farm marketing centers

SECTION 1. Section 46-19-110 of the 1976 Code is amended to read:

"Section 46-19-110. Any county or municipality or combination thereof in this State may, at the discretion of its or their governing body or bodies, establish in and for such county or in or near and for such municipality or groups of municipalities a farm marketing center and acquire, own, operate, lease for operation or lease to others for operation such farm marketing center or any part of such center as may appear desirable."

Condemnation-mortgages grants

SECTION 2. Section 46-19-130 of the 1976 Code is amended to read:

"Section 46-19-130. In order to enable any county or municipality or combination thereof as the case may be to acquire a site or sites for the purposes herein specified, they shall have the power of eminent domain and condemnation under such terms and conditions as exist to enable counties to acquire rights-of-way for public roads in South Carolina. Such counties or municipal corporations by their appropriate officers may secure the purchase price of any such property and equipment that may be purchased for such purposes by a first mortgage on such property and equipment and may borrow money and receive and administer grants from the government of the United States under any administration or agency of the United States Government and may comply with all the terms and conditions necessary to borrow such money."

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
