AN ACT TO AMEND SECTIONS 25-3-10 AND 25-3-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE SOUTH CAROLINA STATE GUARD, SO AS TO REQUIRE THE ADJUTANT GENERAL TO ESTABLISH THE STATE GUARD'S TABLE OF ORGANIZATION AND EQUIPMENT AND TO DELETE RELATED DUTIES OF THE GOVERNOR.

Be it enacted by the General Assembly of the State of South Carolina:

South Carolina. State Guard established

SECTION 1. Section 25-3-10 of the 1976 Code is amended to read:

"Section 25-3-10. A South Carolina State Guard is hereby established. Such force shall be additional to and district from the National Guard and shall be known as the South Carolina State Guard. The Adjutant General shall organize and maintain within the State, under such regulations as the Secretary of the Army may prescribe for discipline and training, the South Carolina State Guard with such table of organization and equipment as the Adjutant General may deem necessary; provided, however, that no state funds shall be expended unless the State Guard is called into active duty."

Governor may call Guard into state duty

SECTION 2. Section 25-3-20 of the 1976 Code is amended to read:

"Section 25-3-20. Whenever any part of the National Guard of this State is ordered into federal service so as to cause the State to be, in the opinion of the Governor, without proper defense, the Governor may call the South Carolina State Guard into state duty."

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
