AN ACT TO AMEND SECTION 60-17-360, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LICENSE TAXES ON FISHING APPLIANCES, SO AS TO IMPOSE A TAX ON NONRESIDENTS OF TWO HUNDRED DOLLARS PER ONE HUNDRED YARDS FOR THE USE OF ANCHOR GILL NETS, STAKE GILL NETS AND DRIFT GILL NETS, EXCEPT THAT RESIDENTS OF ADJOINING STATES WHICH ALLOW RESIDENTS OF THIS STATE TO USE SUCH NETS FOR THE SAME FEE IMPOSED BY THIS STATE ON ITS RESIDENTS MAY BE ISSUED LICENSES FOR THE SAME FEE AS RESIDENTS OF THIS STATE.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF SOUTH CAROLINA:

Tax on nonresidence

SECTION 1. Item (1) of Section 50-17-360 of the 1976 Code is amended to read:

"(1) Anchor gill nets, stake gill nets and drift gill nets for residents, five dollars for each one hundred yards or fraction and for nonresidents two hundred dollars for each one hundred yards or fraction. If an adjoining state allows residents of this State to use such nets in its waters for the same license fee this State imposes on its residents, the Department may issue to a resident of such adjoining state a license to use such nets in this state's waters upon payment of the same fee imposed upon residents. The owner of the licensed net or seine may obtain the assistance of two persons to assist him in the use of the net or seine without such persons being required to obtain any individual license or license tax ;".

SECTION 2. This act shall take effect upon approval by the Governor.
