AN ACT TO AMEND Act 252 Of 1979, Relating To Single-Member Election Districts In Chester county, so As To Redefine the Districts; To Provide For The Election Of Members Of The Chester County Council And The Chester County School Board Of Trustees; To Establish Their Terms; And To Provide For The Election Of A Seventh Member Of the School Board Of Trustees Who Shall Be Elected From The County At Large And Serve As Chairman.

Be it enacted by the General Assembly of the State of South Carolina:

Chester County Council election districts reapportioned

Section 1. Section 2 of Part 1 of Act 252 of 1979 is amended to read:

"Section 2. One member of the governing body of Chester County shall be elected from each of the following defined single-member election districts:

Section 2. Section 3 of Part 1 of Act 252 of 1979 is hereby deleted.

Terms

Section 3. Pursuant to the provisions of Sections 4 and 5, Part 1 of Act 252 of 1979, the terms of all present council members expire in 1982. For purposes of the 1982 general election, the members elected from Districts 3, 4 and 6 shall be elected for terms of two years each and the members elected from Districts 1, 2 and 5 shall be elected for terms of four years each. Thereafter, their successors shall be elected for terms of four years each and all members of the council shall serve until their successors are elected and qualify.

Section 4. (A) For purposes of the 1982 general election in regard to members of the Chester County School Board of Trustees, only successors to those members whose terms expire in 1982 shall be elected and the other members shall continue to serve until their current terms expire in 1984. One such member shall be elected in 1982 from each of the defined single-member election districts established pursuant to Section 1 of this act in which the present members whose terms expire in 1982 now reside and their successors shall then be elected in the general election every four years thereafter from such election districts.

(B) For purposes of the 1984 general election in regard to members of the Chester County School Board of Trustees, successors to those members whose terms expire in 1984 shall be elected. One such member shall be elected in 1984 from each of the defined single-member election districts established pursuant to Section 1 of this act in which the present members whose terms expire in 1984 now reside and their successors shall then be elected in the general election every four years thereafter from such election districts.

(C) All members elected pursuant to the provisions of subsections (A) and (B) shall serve for terms of four years each and until their successors are elected and qualify.

(D) Notwithstanding the provisions of subsections (A) and (B), if any two incumbent school board members at the time of the 1982 general election reside in the same district as such districts have been reapportioned pursuant to the provisions of Section 1 of this act, the member whose term expires in 1984 shall be deemed to be the member of the board from such district and no election in 1982 to elect a member from such district shall be held. The term of the other incumbent member from that district shall expire on its specified date in 1982.

Board of trustees--election term

Section 5. In addition to the six members of the Chester County School Board of Trustees authorized by the provisions of Act 252 of 1979, there shall be a seventh member of the board who shall be elected in the 1982 general election and in the general election every four years thereafter for a term of office of four years and until his successor is elected and qualifies. This member shall be elected from the district at large by the qualified electors of the district and shall serve as chairman of the board of trustees of the district. The member so elected shall take office on the first day of January following his election. Any vacancy shall be filled for the remainder of the unexpired term by election in the same manner as provided for the original election. In regard to the school board of trustees, this seventh member shall also have the same powers, duties, and authority as pertains to voting, presiding at meetings and other related administrative functions as does the county supervisor insofar as the county council is concerned.

Time effective

Section 6. This act shall take effect upon the approval by the Governor.
