A JOINT RESOLUTION TO AUTHORIZE THE SOUTH CAROLINA TAX COMMISSION, WITH THE APPROVAL OF THE STATE BUDGET AND CONTROL BOARD, TO TRANSFER AN AMOUNT NOT EXCEEDING THREE HUNDRED THOUSAND DOLLARS FROM THE WARRANT REVOLVING FUND TO ITS 1981-82 OPERATING APPROPRIATION FOR POSTAGE AND SUPPLIES IN ORDER TO MAINTAIN THE TAX COMMISSION'S OPERATIONAL ACTIVITIES AT SUBSTANTIALLY THE CURRENT LEVEL.
Whereas, the South Carolina Tax Commission collects over ninety percent of the state's revenue and curtailment in operational finances of the Commission would result in a significant reduction in revenue collection ability; and
Whereas, the present funding of the Tax Commission is inadequate to maintain substantially the present level of operation due to the fact that the travel allowance of the Commission has already been reduced by forty-seven percent and the level of personnel has been frozen at its current level with the possibility of further personnel reductions; and
Whereas, the Tax Commission, realizing the necessity of maintaining an adequate postage account, found it necessary to transfer allowance to postage the amount $300,000.00; and
Whereas, in November and December of 1981, it became apparent to the Board of Economic Advisors that revenue collections were running dangerously short of projected estimates and as a result the State Budget and Control Board further reduced state agency appropriations by 2.19% which amounted in a reduction of $369,887.00 to the Tax Commission; and
Whereas, the Budget and Control Board has subsequently reinstated $200,000.00 of such cut; and
Whereas, the Tax Commission, in spite of freezing all vacancies and reducing the amount for travel expense, will nevertheless experience a shortage of $300,000.00 which will result in less state revenue being collected for the current fiscal year; and
Whereas, the Tax Commission, through the Warrant Division, collects a five percent cost for administering the collection of warrants, which five percent cost collections are placed in a fund known as the Warrant Revolving Fund and this fund at the end of the fiscal year is transferred to the state general fund; and
Whereas, the Warrant Revolving Fund for this fiscal year has not yet been earmarked for a particular purpose or appropriation. Now therefore,
Be it enacted by the General Assembly of the State of South Carolina:
Tax Commission authorized to transfer not exceeding $300,000
Section 1. Notwithstanding any other provision of law, and upon approval of the State Budget and Control Board, the South Carolina Tax Commission is hereby authorized to transfer from the Warrant Revolving Fund to its 1981-82 operating appropriation for postage and supplies an amount not exceeding three hundred thousand dollars. This transfer is being authorized so that the Tax Commission can maintain its operational activities at substantially the current level.
Time effective
Section 2. This act shall take effect upon the approval by the Governor.
