AN ACT TO AMEND ACT 270 OF 1981, RELATING TO THE METHOD OF ELECTION AND TERMS OF OFFICE OF MEMBERS OF THE BOARD OF TRUSTEES OF FORT MILL SCHOOL DISTRICT NO. 4 IN YORK COUNTY, SO AS TO PROVIDE THAT THOSE TRUSTEES ELECTED IN NOVEMBER OF 1982 SHALL SERVE TERMS OF THREE YEARS AND TO PROVIDE THAT THE BOARD MAY FILL A VACANCY INSTEAD OF REQUIRING THEM TO FILL SUCH VACANCY.

Be it enacted by the General Assembly of the State of South Carolina:

Board of Trustees--Fort Mill School District No. 4--terms

Section 1. The first paragraph of Section 1 of Act 270 of 1981 is amended by changing the period after "each" on line eight to a semicolon and adding: "provided, that those trustees elected in November of 1982 shall serve a term of three years." and by striking "shall" on line fifteen and inserting "may" so that when amended the paragraph shall read:

"Notwithstanding any other provision of law, the terms of the present members of the Board of Trustees of Fort Mill School District No. 4 in York County rather than expiring in March of the year in which such terms are scheduled to expire shall instead expire on the following January first. Successors to these present members shall then be elected from the district at large by the qualified electors of the district in the manner hereinafter provided for terms of office of four years each; provided, that those trustees elected in November 1982 shall serve a term of three years. Trustees to succeed members whose terms expire on a particular January first shall be elected in an election to be conducted by the county election commission at the same time as the general election immediately preceding that January first. These persons so elected shall take office on the first day of January immediately following their election and all trustees shall serve until successors have been elected and qualify. The board may fill a vacancy occurring for any reason other than expiration of a term by election of a new trustee by majority vote which new trustee shall serve for the remainder of the unexpired term."

Section 2. This act shall take effect upon the approval by the Governor.
