AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 34-11-120, SO AS TO REQUIRE NOTIFICATION TO A BANK OR TRUST COMPANY WHEN A POSTDATED CHECK IS DRAWN AND TO ABSOLVE SUCH BANK OR TRUST COMPANY OF LIABILITY FOR ERRONEOUS PAYMENT IF SUCH NOTICE IS NOT GIVEN.
Be it enacted by the General Assembly of the State of South Carolina:
Post dated check
Section 1. The 1976 Code is amended by adding:
"Section 34-11-120. It shall be the duty of the person drawing a postdated check to notify, in writing, the bank or trust company upon which such check is drawn, giving a complete description thereof, including the name of the payee, the date, the number and amount thereof; otherwise, the bank or trust company shall not be liable for erroneously paying such check."
Time effective
Section 2. This act shall take effect upon the approval by the Governor.
