AN ACT TO AMEND SECTION 7-7-140, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO VOTING PRECINCTS IN CHARLESTON COUNTY, SO AS TO REDEFINE SUCH VOTING PRECINCTS; TO AMEND THE 1976 CODE BY ADDING SECTION 7-7-146 SO AS TO PROVIDE VOTING PLACES FOR THE PRECINCTS; AND TO REPEAL ACT 664 OF 1976, RELATING TO VOTING PLACES IN CHARLESTON COUNTY, AND SECTION 7-7-150 OF THE 1976 CODE, RELATING TO THE MOUNT PLEASANT VOTING PRECINCT IN CHRIST CHURCH PARISH.

Be it enacted by the General Assembly of the State of South Carolina:

Voting precincts in Charleston County

Section 1. Section 7-7-140 of the 1976 Code, as last amended by Act 395 of 1980, is further amended to read:

"(a) In Charleston County there shall be the following precincts:

St. James-Santee Precincts--Beginning at the intersection of the South Santee River and U. S. Highway 17 and proceeding along the following course--southwest along U. S. Highway 17 to the intersection of U. S. Highway 17 and S. C. Highway 857; northeast along S. C. Highway 857 to the intersection of Charleston County Road 71; South along Charleston County Road 71 to the intersection of Chance Road; northwest along Chance Road to the intersection of Mercantile Road; southwest along Mercantile Road to S. C. Highway 1189; northwest along S. C. Highway 1189 to the intersection of U. S. Highway 17; southwest along U. S. Highway 17 to the intersection of S. C. Highway 1335; northwest along S. C. Highway 1335 and an extended dirt road of S. C. Highway 1335 to the intersection of S. C. Highway 913 with Sandy Point Creek and proceeding along the following course--South along Sandy Point Creek to confluence of said waters with Harbor River; South along Harbor River to the confluence with Bull Bay; South along Bull Bay to the confluence of said waters with the Atlantic Ocean; southwest along the Atlantic Ocean to the confluence of said waters with Price Creek; northwest along Price Creek to the confluence of said waters with Clawson Creek; then generally northeast along Clawson Creek to an extended line of the entrance road to the Santo Sotille Ranch; northwest along the extended line and entrance road to the intersection of S. Highway 17 and the waters of the Cooper River and proceeding along the following course--North along the Cooper River to the confluence of said waters with Wando River; northeast along the Wando River to the confluence of said waters with Hobcaw Creek; southeast along Hobcaw Creek to an extended line of Muirhead Road; South along Muirhead Road to the intersection of Mathis Ferry Road; southwest along Mathis Ferry Road to the intersection of the corporate limits of Mt. Pleasant; North, West, and South along the corporate limits to the intersection of U. S. Highway 17; northwest along U. S. Highway 17 to the point of the beginning.

Christ Church Precinct No. 2--Beginning at the intersection of the waters of Wando River with S. C. Highway 41 and proceeding along the following course--South along S. C. Christ Church Precinct No. 3--Beginning at the intersection of U. S. Highway 17 with Venning Road and proceeding along the following course--Southeast along Venning Road to the intersection of Rifle Range Road; northeast along Rifle Range Road to the intersection of Hamlin Road; southeast along Hamlin Road and an extended line to the waters of Hamlin Sound; southeast across Hamlin Sound to the confluence of said waters with Dewees Creek; East along the waters of Dewees Creek to the confluence of said waters with Seven Reaches Creek; southwest along Seven Reaches Creek and intracoastal waterway to confluence of said waters with Conch Creek and corporate boundary of Mt. Pleasant Precinct No. 1--Beginning at the intersection of Royal Street with Center Street and proceeding along the following course--Northeast along Center Street to the intersection of Simmons Street; northeast along Simmons Street to the intersection of McCants Drive; northeast along McCants Drive to the intersection of S. C. Highway 703 and corporate limits of Mt. Pleasant; then generally South, North, East, and West along the corporate limits to the waters of Conch Creek; southeast along waters of Conch Creek to the confluence of said waters with the intracoastal waterway; southwest along the waters of the intracoastal waterway to the confluence of said waters with the Cove; North along the Cove and a tidal creek to an extended line of Royall Street; northwest along the extended line and Royall Street to the point of the beginning.

Mt. Pleasant Precinct No. 2--Beginning at the intersection of Shem Creek and Coleman Boulevard (U. S. Highway 17--Business) and proceeding along the following course--southeast along Coleman Boulevard to the intersection with Simmons Street; southeast along Simmons Street to the intersection with Center Street; West along Center Street to the intersection with Royall Street; South along Royall Street and continuing along an extension of Royall Street to a creek leading to the Cove; said precinct is bounded on the West by the Charleston Harbor and on the North by Shem Creek.

Mt. Pleasant Precinct No. 3--Beginning at the intersection of Shem Creek and U. S. Highway 17 and S. C. Highway 701 and proceeding along the following course--generally North, East, West, and South along the corporate boundary of Mt. Pleasant to the waters of Shem Creek and Charleston Harbor; West along the waters of Charleston Harbor to the confluence of said waters with Cooper River; North along the Cooper River to the intersection of U. S. Highway 17; East along U. S. Highway 17 to the intersection of Mathis Ferry Road; northeast along Mathis Ferry Road to the corporate limits of Mt. Pleasant; generally East, North, and South along the corporate limits to an extended line from Cooper Lake; South along the waters of Cooper Lake and Cooper Creek to the confluence of said waters with Shem Creek; southwest along Shem Creek to the point of the beginning.

Mt. Pleasant Precinct No. 4--Beginning at the intersection of McCants Drive with Coleman Boulevard and proceeding along the following course--northwest along Coleman Boulevard to Shem Creek; East along the waters of Shem Creek to the confluence of said waters with Cooper Creek; North along Cooper Creek, Cooper Lake and an extended line to the corporate limits of Mt. Pleasant; then East and North along the corporate limits to U. S. Highway 17; northeast along U. S. Highway 17, excluding an unincorporated area of Mt. Pleasant to the South, to the intersection of Bowman Road; northwest along Bowman Road to the intersection with Mathis Ferry Road and corporate limits of Mt. Mt. Pleasant Precinct No. 5--Beginning at the intersection of McCants Drive and Simmons Street and proceeding along the following course--North on Simmons Street until the intersection with Coleman Boulevard; East on Coleman Boulevard to the intersection with McCants Drive; West on McCants Drive to the point of the beginning.

Mt. Pleasant Precinct No. 6--All that incorporated area of the town of Mt. Pleasant bound on the North and West by Christ Church 2; South by Mt. Pleasant Precinct 4 and Christ Church 3; East by Whipple Road.

Mt. Pleasant Precinct No. 7--All that area included in the corporate limits of the City of Mt. Pleasant East of Whipple Road; said precinct is bounded on the North and East by S. C. Highway 97 and on the South by U. S. Highway 17.

Mt. Pleasant Precinct No. 8--All that area of Charleston County East of the Cooper River, located within House District 109, that is included in the corporate limits of the City of Mt. Pleasant, bounded on the South by U. S. Highway 17 by-pass, on the North, East and West by Christ Church Precinct No. 1.

Isle of Palms Precinct No. 1--All that area of the City of Isle of Palms, lying West of 30th Avenue.

Isle of Palms Precinct No. 2--All that area of the City of Isle of Palms, lying East of 30th Avenue.

Sullivans Island Precinct--Bounded on the North by the Intracoastal Waterway; bounded on the South by the Atlantic Ocean; bounded on the West by the Cooper River; and bounded on the East by Breach Inlet and Swinton Creek.

City of Charleston

Charleston Precinct No. 1--Beginning at the intersection of Logan Street and Broad Street and proceeding along the following course--East along Broad Street to the intersection with Church Street; South along Church Street to the intersection with Water Street; East along Water Street extending across East Battery to the waters of Charleston Harbor; South and West along the waters of Charleston Harbor to the intersection of Murray Boulevard with Lenwood Boulevard; North along Lenwood Boulevard to the intersection of Lenwood Boulevard with Tradd Street; East a short distance along Tradd Street and Logan Street; North along Logan Street to the point of beginning.

Charleston Precinct No. 2--Beginning at the intersection of Wentworth Street with Coming Street and proceeding along the following course--East along Wentworth Street to King Street; North along King Street to the intersection with Society Street; East along Society Street and Anson Street; North along Anson Street to the intersection of Anson Street with Laurens Street; East along Laurens Street extending across East Bay and Concord Streets to the waters of Charleston Harbor and the Cooper River; South along the waters of Charleston Harbor to the intersection of Water Street with East Battery; West along Water Street to the intersection of Church Street; North on Church Street to Broad Street; West along Broad Street to the intersection of Broad Street and Logan Street; North along Logan Street to the intersection of Logan Street, Beaufain Street, and Coming Street; North along Coming Street to Wentworth Street to the point of beginning.

S. Highway 17; southeast along U. S. Highway 17 to the corporate limits of the City of Charleston; South and East along corporate limits to Stinson Drive and Seaboard Coast Line Railroad. Then at the intersection of Longbranch Creek and Seaboard Coast Line spur track and proceeding along the following course--North along Longbranch Creek to Seaboard Coast Line Railroad track and corporate limits of the City of Charleston; then East, South, and West to Seaboard Coast Line spur track; southwest along Seaboard Coast Line spur track to Longbranch Creek. Midland Park Precinct--Beginning at the Seaboard Coast Line Railroad tracks and S. C. Goodwin Precinct No. 1--All of the unincorporated area beginning at the intersection of Dorchester Road and West Montague Avenue and the corporate limits of North Charleston and proceeding along the following course--extending West along said corporate limits to the Seaboard Coast Line Railroad tracks; West on said tracks to the Ashley River; northwest on the Ashley River to Lambs Road; northeast on Lambs Road to Dorchester Road; generally southeast on Dorchester Road to Marilyn Drive and the corporate limits of North Charleston; East and South along said corporate boundaries to the point of the beginning.

Wando-Waylyn Precinct No. 1--All of the unincorporated area of Charleston County beginning at the intersection of U. S. Interstate 26 and West Montague Avenue and proceeding along the following course--generally southwest on Montague Avenue to the intersection of West Montague Avenue and Dorchester Road; including all the unincorporated area to the North, East, South, and West of West Montague Avenue to the Seaboard Coast Line Railroad tracks on the South and the surrounding corporate limits of the City of North Charleston.

Wando-Waylyn Precinct No. 2--Beginning at the intersection of the Seaboard Coast Line Railroad and the Southern Railroad tracks near U. S. Interstate 26 and proceeding along the following course--southeast down the railroad tracks to Dorchester Road; West on Dorchester Road to the intersection of Dorchester Road and a spur railroad track near Industrial Avenue; North on said tracks to the Seaboard Coast Line Railroad tracks; generally East on the tracks to the point of the beginning.

Wando-Waylyn Precinct No. 3--Beginning at a point on the Ashley River and the confluence of Brickyard Creek and proceeding along the following course--West on Ashley River to the Seaboard Coast Line Railroad tracks; East on said Seaboard Coast Line Railroad tracks to spur railroad tracks along Industrial Avenue; South on spur railroad tracks to Azalea Avenue; West on Azalea Avenue to extended line of Brickyard Creek; proceeding generally South to the point of the beginning.

St. Phillips and St. Michael's Precinct--Beginning at the intersection of Meeting Street Road and the corporate limits of the City of Charleston and proceeding along the following course--North up Meeting Street Road to the U. S. Interstate 26 ramp and proceeding North approximately 1 mile on U. S. Interstate 26 to an extended line of Stromboli Street; along said extended line northeast to the Seaboard Coast Line Railroad tracks; northwest on said tracks to the corporate boundary of the City of North Charleston; generally North, South, East, and West along said corporate lines to the intersection of Pittsburg Avenue and the corporate boundary of the City of Charleston; southwest along the corporate boundaries of the City of Charleston to the point of the beginning.

Azalea Precinct No. 2--All of the unincorporated area beginning at the intersection of Woodlawn Avenue and Dorchester Avenue and proceeding along the following course--East on Dorchester Avenue to Seaboard Coast Line Railroad tracks; South down said tracks to the extended line of Stromboli Avenue; southwest on said extended line to U. S. Interstate 26; generally West on U. S. Highway 390 to the intersection of Toogoodoo Creek; South along Toogoodoo Creek to the intersection of the Wadmalaw River; South along the Wadmalaw River to the confluence of the North Edisto River; northwest along Edisto River to Dawhoo River; northwest on Dawhoo River to the confluence of the South Edisto River; North on the South Edisto River to the point of the beginning.

Edisto Precinct--All that area known as Edisto Island except for Edisto Beach; bounded on the South by the Atlantic Ocean and Edisto Beach; bounded on the West by the South Edisto River; bounded on the North by the Dawhoo River; and bounded on the East by the North Edisto River.

Wadmalaw Precinct--All of the unincorporated area of Charleston County known as Wadmalaw Island; bounded on the West by North Edisto River, on the North by Wadmalaw River, on the East by Church Creek, and on the South by Bohicket Creek.

John's Island Precinct No. 1--Beginning at the confluence of New Cut Creek and Church Creek and proceeding along the following course--northeast on New Cut Creek to the confluence of the Stono River; East and South on the Stono River to an extended line of S. C. Highway 1442; southeast on S. C. Highway 1442 to the intersection of a tidal creek located just above S. C. Highway 700 and Church Creek; West on Church Creek to the point of the beginning.

John's Island Precinct No. 2--Beginning at the point where S. C. Highway 700 crosses the Stono River and proceeding along the following course--West on S. C. Highway 700 until it reaches Church Creek; Northwest on Church Creek to the confluence of the first tidal creek; northeast along said tidal creek; North on S. C. Highway 1442 to S. C. Highway 54; East on S. C. Highway 54 approximately one-half mile; North on a tidal creek to the Stono River; East on the Stono River to the point of the beginning.

John's Island Precinct No. 3--Beginning at the intersection of S. C. Highway 700, and the Stono River and proceeding along the following course--South on the Stono River to a tidal creek located one-half mile from the intersection of S. C. Highway 54 and S. C. Highway 1156; southwest on S. C. Highway 54 to S. C. Highway 91; West on S. C. Highway 91 to S. C. Highway 20; northeast on S. C. Highway 20 to Cottage Plantation Road; West on Cottage Plantation Road to Bohicket Creek; East on Bohicket Creek to S. C. Highway 700; East on S. C. Highway 700 to the point of the beginning.

John's Island Precinct No. 4--Beginning at the point where the Stono River meets the Atlantic Ocean and proceeding along the following course--Southwest along the Atlantic Ocean to the confluence of the North Edisto River; West up the North Edisto River to Bohicket Creek; Northeast on Bohicket Creek to Cottage Plantation Road; East on Cottage Plantation Road to S. C. Highway 20; southwest on S. C. Highway 20 to S. C. Highway 91; northeast on S. C. Highway 91 and S. C. Highway 54 to a tidal creek located approximately one-half mile South on S. C. Highway 1156; East on said tidal creek to the Stono River; South on the Stono River to the point of the beginning on the Atlantic Ocean.

(b) The Charleston County Election Commission shall designate, from time to time, the polling place in each precinct."

Repeal

Section 3. Act 664 of 1976 and Section 7-7-150 of the 1976 Code are repealed.

Time effective

Section 4. This act shall take effect upon approval by the Governor, except that the precincts as defined herein shall be effective as to elections beginning with the general election of 1982.
