AN ACT TO AMEND SECTIONS 9-1-860 AND 9-11-220, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE SOUTH CAROLINA RETIREMENT SYSTEM AND THE SOUTH CAROLINA POLICE OFFICERS RETIREMENT SYSTEM, SO AS TO DESIGNATE THAT THE CURRENT EMPLOYER MAKE CONTRIBUTIONS AT THE TIME AN EMPLOYEE ESTABLISHES A PRIOR SERVICE CREDIT.

Be it enacted by the General Assembly of the State of South Carolina:

Current employer to make contributions

Section 1. Section 9-1-860 of the 1976 Code is amended on line eleven by adding after "date.": "The employer contribution required by this section and Section 9-1-440 shall be paid by the current employer." The section when amended shall read:

"Section 9-1-860. All counties, municipalities or other political subdivisions of the State, any agencies and departments thereof including school boards and any service organization as defined in item (4) of Section 9-1-10 may avail themselves of the provisions of Section 9-1-470 without loss or prejudice to their affected employees' or teachers' claims to prior service credits but such electing employers and their employees or teachers shall be subject to the payment of such contributions, if any, as the Board may determine to be necessary to avoid any possible discrimination as against employers and employees or teachers coming under the terms hereof at an earlier date. The employer contribution required by this section and Section 9-1-440 shall be paid by the current employer. But the compensation received by the employees of such service organizations shall be provided from monies paid by the members as dues or otherwise or from funds derived from public sources. The employer contributions prescribed by this shall be paid from the fund of the service organizations."

Further

Section 2. Item (c) of subsection (2) of Section 9-11-220 of the 1976 Code is amended by adding at the end: "The employer contribution required by this subsection shall be paid by the current employer." When amended the item shall read:

"(c) If the special contribution is made pursuant to Section 9-11-210(4), the employer contribution shall be equal to a percentage of the member's monthly rate of compensation at the time such special contribution is made multiplied by the number of months of service for which credit is to be established. Such percentage shall be seven and one-half percent in the case of a Class One member and ten percent in the case of a Class Two member. The employer contribution required by this subsection shall be paid by the current employer."

Time effective

Section 3. This act shall take effect upon the approval by the Governor.
