AN ACT TO AMEND ACT 237 OF 1979, RELATING TO THE BAMBERG COUNTY BOARD OF EDUCATION, SO AS TO DELETE THE PROVISION REQUIRING A NONPARTISAN ELECTION CONDUCTED BY THE BAMBERG COUNTY ELECTION COMMISSION FOR SUCH BOARD.

Be it enacted by the General Assembly of the State of South Carolina:

Board of education reconstituted

Section 1. Section 1 of Act 237 of 1979 is amended to read:

"Section 1. There is hereby reconstituted the Bamberg County Board of Education which shall consist of eight members, seven of whom shall be elected from and be residents of the seven election districts from which members of the county council are elected, as provided by Act 784 of 1976. Each member shall be elected by the qualified electors of the district he represents. The initial members shall be elected in a special election in November, 1979 with terms commencing January 1, 1980, and ending January 1, 1983. Commencing in 1982 the members shall be elected in the general election for terms of four years and until their successors are elected and qualify, except that of those elected in 1982 three shall serve for two years only. The terms of the members elected in 1982 shall commence January 1, 1983, and the length of the terms shall be determined by lot at the first meeting of the board. Vacancies of elected members shall be filled by a majority of the remaining members of the board for the unexpired portion of the term only. The eighth member of the board shall be the county superintendent of education who shall serve ex officio without voting rights and who shall be chairman of the board. The superintendent shall be elected from the county at large."

Section 2. This act shall take effect upon the approval by the Governor.
