AN ACT TO AMEND SECTION 50-11-970, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, AND ACT 485 OF 1976, AS AMENDED, RELATING TO OPEN AND CLOSED SEASONS FOR THE HUNTING OF GAME IN GAME ZONE 9 AND HUNTING OF RACCOON AND OPOSSUM, SO AS TO CHANGE THE OPEN SEASON FOR HUNTING RACCOON AND OPOSSUM IN GAME ZONE 9 AND TO ESTABLISH THE NUMBER OF RACCOONS AND OPOSSUMS WHICH MAY BE TAKEN BY HUNTERS IN GAME ZONE 9.

Be it enacted by the General Assembly of the State of South Carolina:

Open season for hunting raccoon and opossum

SECTION 1. Item (5) of Section 50-11-970 of the 1976 Code, as last amended by Section 1 of Act 119 of 1981, is further amended to read:

"(5) The open season for hunting raccoon and opossum is from September fifteenth through March fifteenth and only at night; except that raccoon and opossum may be hunted without firearms from September fifteenth through October fourteenth and from March second through March fifteenth. For the purpose of this item 'night' means that period from official sundown to official sunrise of the following day."

SECTION 2. Section 11 of Act 485 of 1976, as last amended by Act 119 of 1981, is further amended to read:

"Section 11. In Game Zones Nos. 1, 2, and 4 it is unlawful for any person or any hunting party to take more than three raccoons or more than three opossums per night. For the purpose of this section 'hunting party' means any group of persons engaged in the hunting of raccoons or opossums together; and 'night' means that period from official sundown to official sunrise of the following day."

Hunting party defined

SECTION 3. In Game Zone No. 9 it is unlawful for any person or any hunting party to take more than two raccoons or more than two opossums per night. For the purpose of this section 'hunting party' means any group of persons engaged in the hunting of raccoons together; and 'night' means that period from official sundown to official sunrise of the following day. There is no limit on the number of opossums which may be taken per night.

Time effective

SECTION 4. This act shall take effect upon approval by the Governor.
