AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 14-7-455 SO AS TO PROVIDE THAT THE CLERK OF COURT OF A COUNTY MAY SERVE A SUMMONS FOR JURY DUTY BY FIRST CLASS MAIL, OR, IN THE ALTERNATIVE, THAT THE CLERK OF COURT MAY CONTRACT WITH THE STATE ELECTION COMMISSION FOR THE SERVICE OF A SUMMONS FOR JURY DUTY BY FIRST CLASS MAIL, TO PROVIDE THAT SHOULD THE CLERK OF COURT DECIDE NOT TO SO SUMMON JURORS, JURORS MUST CONTINUE TO BE SUMMONED AS PROVIDED BY LAW, AND TO AMEND SECTION 14-7-465 SO AS TO PROVIDE THAT THE CLERK OF COURT OF ANY COUNTY MAY SERVE A SUMMONS FOR JURY DUTY BY CERTIFIED MAIL WITH RETURN RECEIPT REQUESTED AND IF HE DECIDES NOT TO USE THE PROCEDURE PROVIDED BY THIS SECTION THE SHERIFF MUST CONTINUE TO SERVE JURORS AS PROVIDED BY LAW.

Be it enacted by the General Assembly of the State of South Carolina:

Clerk of Court may serve summons for jury duty

SECTION 1. The 1976 Code is amended by adding:

"Section 14-7-455. The clerk of court of any county may serve a summons for jury duty by first class mail. In the alternative, the clerk of court of any county may contract with the State Election Commission to serve a summons for jury duty by first class mail. Should the clerk of court of any county not choose to use either of the procedures for summoning jurors provided by this section, the clerk may summon jurors as provided by Section 14-7-465 or the sheriff must serve jurors as provided by Section 14-7-460."

Further

SECTION 2. Section 14-7-465 of the 1976 Code, as added by Act 370 of 1980, is amended to read:

"Section 14-7-465. The clerk of court of any county may serve a summons for jury duty by certified mail with return receipt requested. Should the clerk of court of any county not choose to use the procedure for summoning jurors provided by this section, the sheriff must continue to serve jurors as provided by law."

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
