AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 31-3-170, SO AS TO DEFINE FURTHER THE POWERS OF THE SOUTH CAROLINA STATE HOUSING AUTHORITY BY AUTHORIZING IT TO PROVIDE ADVICE OR TECHNICAL ASSISTANCE TO PUBLIC AND NONPROFIT ENTITIES AND TO FEDERAL AGENCIES AND AUTHORIZING IT TO MAKE AND EXECUTE CONTRACTS WITH POLITICAL SUBDIVISIONS OF THE STATE, NONPROFIT ENTITIES, AND FEDERAL AGENCIES SO THAT THE STATE HOUSING AUTHORITY MAY PROVIDE SUCH ADVICE OR TECHNICAL ASSISTANCE, TO REQUIRE THAT SUCH ADVICE OR TECHNICAL ASSISTANCE, WHEN OFFERED TO NON-GOVERNMENTAL ENTITIES, BE IN PARTICIPATION WITH PRIVATE ENTERPRISE, AND TO MAKE PROVISIONS WITH RESPECT TO THE ABILITY TO ENTER INTO CONTRACTS FOR THE PROVISION OF ADVICE OR TECHNICAL ASSISTANCE.

Whereas, the General Assembly finds that the many economic

difficulties and unusually high unemployment facing the people of South Carolina have had a severe impact upon the State's housing industry; and

Whereas, the General Assembly further finds that successful financing of single family housing has been implemented by the South Carolina State Housing Authority (Authority) with the proceeds from the sale of single family mortgage purchase bonds; and

Whereas, the General Assembly finds that the Authority's procedures, which should include and utilize the resources of private enterprise, could be of continuing assistance to the housing industry through contracts to provide certain services to public and private entities within the State, thus assisting the economy of the State in general and that of the State's housing industry in particular. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Authority may provide advice and assistance

SECTION 1. The 1976 Code is amended by adding:

"Section 31-3-170. The State Housing Authority may provide advice or technical assistance to public and nonprofit entities and to federal agencies so as to stimulate the housing industry and to relieve unemployment. The ability to enter into contracts for the provision of advice or technical assistance as provided by this section is not limited by the economic class of any individual who may benefit from such contract.

Contracts may be made and executed with political subdivisions of the State, nonprofit entities, and federal agencies engaged in providing or promoting the development of housing resources within the State so that the State Housing Authority may provide advice or technical assistance. All such advice or technical assistance, when offered to non-governmental entities, must be in participation with private enterprise."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
