AN ACT TO AMEND SECTION 33-51-130, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PROFESSIONAL ASSOCIATIONS FILING WITH THE SECRETARY OF STATE, SO AS TO INCREASE THE AMOUNT OF THE FILING FEE FROM ONE DOLLAR TO TWENTY DOLLARS.

Be it enacted by the General Assembly of the State of South Carolina:

Association to furnish statement to Secretary of State

SECTION 1. Section 33-51-130 of the 1976 Code is amended to read:

"Section 33-51-130. A professional association shall, within thirty days after the organization of the professional association pursuant to the provisions of this chapter and within thirty days after the first day of November in each year thereafter, furnish a statement to the Secretary of State showing the names and post office addresses of all members or shareholders in the professional association and shall certify that all members or shareholders are duly licensed or otherwise legally authorized to render professional service in this State. This report must be made on the form which must be prescribed and furnished by the Secretary of State. It must be signed by the president of the professional association, acknowledged and sworn to before a notary public by the person signing the report, and filed in the office of the Secretary of State, together with a filing fee in the amount of twenty dollars. Upon the failure or refusal of any professional association to make the return or report to the Secretary of State, the professional association is liable for a penalty of fifty dollars, and the Secretary of State is authorized to issue his execution for the penalty, including all costs incurred."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
