AN ACT TO AMEND SECTION 50-17-2210, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO FISHING NETS NEAR THE WINYAH BAY JETTIES, SO AS TO PROVIDE FOR SEIZURE AND DISPOSITION OF BOATS, NETS, AND CATCH UNLAWFULLY USED OR CAUGHT.

Be it enacted by the General Assembly of the State of South Carolina:

Fishing with nets near Winyah Bay jetties

SECTION 1. Section 50-17-2210 of the 1976 Code, as last amended by Act 12 of 1979, is further amended to read:

"Section 50-17-2210. It is unlawful to fish at any time with gill nets, anchor nets, stake row nets, or pound nets in an area of the Atlantic Ocean off Winyah Bay described as follows: within three nautical miles of the midpoint of a line extending from the point where the north jetty of Winyah Bay intersects the beach at North Island running in a southwesterly direction to the point where the south jetty of Winyah Bay intersects the beach at Sand Island, including all waters between the jetties. It is lawful to fish for atlantic sturgeon in the area previously described with nets having a mesh size in compliance with Section 50-17-2280 from February fifteenth through April fifteenth of any year. In addition to penalties provided in Section 50-17-130, the catch, nets, and boats of any person accused of violating the provisions of this section shall be seized and upon conviction disposed of as provided in Section 50-17-1615, except the provisions relating to redemption shall not apply."

SECTION 2. This act shall take effect upon approval by the Governor.
