AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-11-3006, SO AS TO DESIGNATE CERTAIN AREAS OF BIG ALLISON CREEK AND LITTLE ALLISON CREEK IN YORK COUNTY A BIRD SANCTUARY; TO PREVENT THE TRAPPING, HUNTING, OR MOLESTING OF BIRDS OR WILD FOWL WITHIN THE SANCTUARY; AND TO PROVIDE PENALTIES FOR VIOLATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

Area designated as bird sanctuary

SECTION 1. The 1976 Code is amended by adding:

"Section 50-11-3006. The area in York County, consisting of a portion of the empounded waters of Lake Wylie in Big Allison Creek and Little Allison Creek, beginning on the shoreline of Lake Wylie at the Ebenezer Boat Landing, located at the northern extremity of Boat Shore Road, near the convergence of the stream bed of Allison Creek (at Lot 160, Section 7 in property now or formerly of Crescent Land and Timber Company) with the stream bed of the Catawba River, and extending thence northwesterly in a straight line across the empounded waters of Lake Wylie to the point on its shoreline across the empounded waters of Lake Wylie to the point on its shoreline near the easternmost extremity of Allison Creek Road; and extending thence continuously with the shoreline of Lake Wylie in a counterclockwise direction to the point of beginning, and containing approximately two square miles, is designated a bird sanctuary. It is unlawful for any person to trap, hunt, molest, or attempt to molest in any manner any bird or wild fowl or to molest any birds or wild fowls nested within the sanctuary. Any person violating the provisions of this section is guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not more than one hundred dollars or by imprisonment for not more than thirty days."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
