AN ACT TO AMEND SECTION 50-1-30, AS AMENDED, AND SECTION 50-11-2410, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CLASSIFICATIONS OF BIRDS, ANIMALS, AND FISH, AND KILLING OR POSSESSING WILD NONGAME BIRDS, SO AS TO COMPLY WITH FEDERAL LAW BY DELETING CROW, GRACKLE, COWBIRD, AND BLACKBIRD FROM THE LIST OF DESTRUCTIVE BIRDS AND TO ADD PIGEON TO THE LIST, AND TO DELETE BUZZARDS FROM THE LIST OF BIRDS EXCEPTED FROM PROTECTION; TO REPEAL SECTIONS 50-11-450, 50-11-2240, 50-11-2250, 50-11-2260, 50-11-2270, 50-11-2280, 50-11-2450, AND 50-11-2460 OF THE 1976 CODE, RELATING TO ALLIGATORS, ALLIGATOR EGGS AND KEEPING BIRDS FOR SCIENTIFIC, HOUSEHOLD, OR PROPAGATING PURPOSES.

Be it enacted by the General Assembly of the State of South Carolina:

Destructive bird list

SECTION 1. Item (2) of Section 50-1-30 of the 1976 Code is amended to read:

"(2) English sparrow, pigeon, and starling. These birds are unprotected by South Carolina law."

Prohibition on killing, etc. certain birds

SECTION 2. Section 50-11-2410 of the 1976 Code is amended to read:

"Section 50-11-2410. No person within the State may kill, catch, or have in his possession, living or dead, any resident or migratory wild bird, other than a game bird, or purchase, offer or expose for sale any such wild nongame bird after it has been killed or caught, except as permitted by Section 50-11-2190."

Repeal

SECTION 3. Sections 50-11-450, 50-11-2240, 50-11-2250, 50-11-2260, 50-11-2270, 50-11-2280, 50-11-2450, and 50-11-2460 of the 1976 Code are repealed.

Time effective

SECTION 4. This act shall take effect upon approval by the Governor.
