AN ACT TO AMEND SECTION 6-7-360, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LOCAL PLANNING ORGANIZATIONS, SO AS TO PROVIDE THAT UP TO FIFTY PERCENT OF THE MEMBERS MUST RESIDE OUTSIDE THE LIMITS OF A MUNICIPAL CORPORATION BASED ON THE PERCENTAGE OF POPULATION OF THE AREA OF THE COMMISSION WHICH LIVE WITHOUT MUNICIPAL CORPORATION LIMITS.

Be it enacted by the General Assembly of the State of South Carolina:

Local planning commission

SECTION 1. Section 6-7-360 of the 1976 Code is amended to read:

"Section 6-7-360. A local planning commission serving not more than two political jurisdictions shall have not less than five nor more than nine members. A local planning commission serving three or more political jurisdictions shall not have a membership greater than four times the number of jurisdictions it serves. Up to fifty percent of the members must reside outside the limits of a municipal corporation based on the percentage of population of the area of the commission which live without municipal corporation limits.

No member of a planning commission may hold an elected public office in the municipality or county from which he is appointed. Members of the commission first to serve shall be appointed for staggered terms as described in the agreement of organization and shall serve until their successors are appointed and qualified. The compensation of the members, if any, shall be determined by the governing authority or authorities creating the commission. Any vacancy in the membership of a planning commission shall be filled for the unexpired term in the same manner as the original appointment. The governing authority or authorities creating the commission may remove any member of the commission for cause after written notice and public hearing."

Additional members to be appointed

SECTION 2. After the effective date of this act, if a commission does not have sufficient members residing outside municipal corporation limits to comply with population percentage requirements of Section 6-7-360 of the 1976 Code, additional members must be appointed to comply with the population percentage requirements. If members of a commission are designated from specific areas, members must be added to comply with the population percentage requirements.

SECTION 3. This act shall take effect upon approval by the Governor.
