AN ACT TO AMEND ACT 848 OF 1976, AS AMENDED, RELATING TO THE ELECTION AND COMPOSITION OF THE LANCASTER COUNTY BOARD OF EDUCATION AND THE AREA BOARDS OF TRUSTEES OF THE SCHOOL DISTRICT OF THE COUNTY, SO AS TO ELIMINATE STAGGERED TERMS FOR TRUSTEES OF AREA BOARDS AND FOR MEMBERS OF THE COUNTY BOARD OF EDUCATION.

Be it enacted by the General Assembly of the State of South Carolina:

Members elected at large

SECTION 1. Section 1 of Act 848 of 1976 is amended to read:

"Section 1. Notwithstanding any other provision of law, members of the various boards of trustees of the school areas of Lancaster County must be elected at large in the general election by the qualified electors of the area for terms of four years and until successors are elected and qualify. Terms of office shall commence on January first following the year of election. Vacancies on the various boards must be filled by election by majority vote of the remaining members of the particular area board for the unexpired term."

Trustees

SECTION 2. Section 2 of Act 848 of 1976, as last amended by Act 350 of 1977, is further amended to read:

"Section 2. Eight trustees each must be elected for the Lancaster and Andrew Jackson Area School Boards and six each for the Buford and Indian Land Area School Boards. All trustees must be qualified electors of the areas they represent. Of the eight trustees elected for the Andrew Jackson Area, two must be residents of the former Flat Creek District, two must be residents of the former Heath Springs District and four must be residents of the Kershaw District."

Composition of Lancaster County Board of Education

SECTION 3. Section 3 of Act 848 of 1976 is amended to read:

"Section 3. The Lancaster County Board of Education consists of seven members selected as follows:

(a) Three members must be elected at large from the county in the general election of 1984 for terms of four years and until successors are elected and qualify.

(b) Four members must be members of the school area boards of trustees and elected by the boards with one member selected from each area board.

(c) Vacancies on the board among members elected by the area boards must be filled in the manner of original selection. Vacancies among members elected in the general election must be filled by election by the remaining members on the board of education. All vacancies must be filled for the unexpired term."

Terms

SECTION 4. Section 4 of Act 848 of 1976 is amended to read:

"Section 4. Members elected to the area boards of trustees in the general election of 1984 shall serve for a term of two years. Thereafter, members elected to these offices shall serve for a term of four years and until successors are elected and qualify. Candidates shall have their names placed upon the ballot by filing with the county election commission not later than forty-five days prior to the general election."

Time effective

SECTION 5. This act shall take effect upon approval by the Governor.
