AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-1-95, SO AS TO REQUIRE A REPORT TO BE FILED BY ANY PERSON INVOLVED IN A HUNTING ACCIDENT WHICH RESULTED IN INJURY OR DEATH AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

Report required in hunting accidents

SECTION 1. The 1976 Code is amended by adding:

"Section 50-1-95. Any person involved in a hunting accident in which injury or death resulted must within thirty days from the date of the accident file with the South Carolina Wildlife and Marine Resources Department (Department) a report on forms provided by the Department containing a full description of the accident and any other information required by the Department. Any such report is without prejudice, is for the information of the Department and may not be open to public inspection. The report must be made available upon written request to any person injured or damaged in the accident or to his attorney. The fact that the report has been made is admissible in evidence solely to show compliance with this section but no such report nor any part thereof nor any statement contained therein is admissible as evidence for any purpose in any civil trial.

The Department shall administer the State Hunting Casualty Reporting System.

Any person failing to file the report required by this section is guilty of a misdemeanor and upon conviction shall be fined not more than one hundred dollars or imprisoned for not more than thirty days."

SECTION 2. This act shall take effect upon approval by the Governor.
