AN ACT TO CHANGE THE NAME OF THE GREATER GREENVILLE SEWER DISTRICT, ALSO KNOWN AS THE GREENVILLE COUNTY SEWER AUTHORITY, TO THE WESTERN CAROLINA REGIONAL SEWER AUTHORITY; AND TO AMEND ACT 745 OF 1967, RELATING TO THE GREENVILLE COUNTY SEWER AUTHORITY, SO AS TO CHANGE THE NAME OF THE AUTHORITY TO THE WESTERN CAROLINA REGIONAL SEWER AUTHORITY, TO PROVIDE THAT MEMBERS OF THE COMMISSION GOVERNING THE AUTHORITY MUST BE RESIDENTS OF THE COUNTIES COMPRISING THE AUTHORITY AND RESIDENTS OF THE TERRITORY OF THE AUTHORITY, PROVIDE THAT AT LEAST ONE MEMBER MUST BE FROM ANDERSON COUNTY AND ONE FROM LAURENS COUNTY, TO INCREASE THE NUMBER OF MEMBERS OF THE COMMISSION FROM SEVEN TO NINE MEMBERS, AND TO DEFINE "LEGISLATIVE DELEGATION" FOR PURPOSES OF MAKING RECOMMENDATIONS TO THE GOVERNOR FOR APPOINTMENTS TO THE COMMISSION AS HOUSE MEMBERS AND SENATORS WHOSE DISTRICTS INCLUDE ALL OR ANY PART OF THE COUNTY FROM WHICH THE MEMBER MUST BE APPOINTED AND WHOSE DISTRICTS ALSO INCLUDE TERRITORY OF THE AUTHORITY.

Be it enacted by the General Assembly of the State of South Carolina:

Name changed

SECTION 1. The Greater Greenville Sewer District created pursuant to the provisions of Act 362 of 1925 and also known as the Greenville County Sewer Authority is changed to the Western Carolina Regional Sewer Authority and wherever those previously mentioned names appear, the Western Carolina Regional Sewer Authority is substituted in their place.

Composition of governing body

SECTION 2. Section 3 of Act 745 of 1967, as last amended by Act 688 of 1969, is further amended to read:

"Section 3. Notwithstanding the provisions of Act 1021 of 1960, the governing body of the Western Carolina Regional Sewer Authority (formerly designated the Greenville County Sewer Authority) shall consist of a Commission composed of nine members who must be appointed by the Governor upon the recommendation of the legislative delegation of the county from which the member must be appointed. For all other matters respecting the Authority, the legislative delegations of Greenville, Anderson, and Laurens Counties shall act as one entity. A legislative delegation consists of all House members and Senators representing any portion of a county whose districts also include all or any part of the territory of the Western Carolina Sewer Authority. All members of the Commission must be residents of the counties comprising the Western Carolina Regional Sewer Authority and of the territory of the Authority and shall serve at large. One member must be from Anderson County and one member must be from Laurens County. Seven members must be from Greenville County. The Anderson and Laurens County Delegations shall recommend for appointment to the Governor two additional members so as to complete the Commission of nine members. One member must be appointed for a term expiring in December, 1985, and one member for a term expiring in December, 1986, with the respective terms designated in the appointments."

Appointment of members

SECTION 3. The recommendation to the Governor for appointment of the two members added to the Commission by Section 1 of this act must be made by the Anderson and Laurens County Delegations within thirty days of the effective date of this act. For purposes of the recommendation, the delegations shall consist of House members and Senators representing any portion of Anderson and Laurens counties whose districts also include all or any part of the territory of the Western Carolina Sewer Authority.

Time effective

SECTION 4. This act shall take effect upon approval by the Governor.
