A JOINT RESOLUTION TO AUTHORIZE JOHN A. McALLISTER, CHAIRMAN OF THE CLARKS HILL-RUSSELL AUTHORITY OF THE STATE OF SOUTH CAROLINA, OR HIS SUCCESSORS, TO NEGOTIATE AGREEMENTS OR CONTRACTS WITH THE GENERAL SERVICES ADMINISTRATION OF THE UNITED STATES OF AMERICA, AND TO EXECUTE DOCUMENTS, CONTRACTS, AND AGREEMENTS REGARDING THE PURCHASE OF APPROXIMATELY THREE THOUSAND ACRES OF LAND SITUATE IN McCORMICK COUNTY, IN THE CLARKS HILL RESERVOIR AREA OF THE COUNTY, FROM THE GENERAL SERVICES ADMINISTRATION.

Be it enacted by the General Assembly of the State of South Carolina:

Findings

SECTION 1. The General Assembly finds and determines:

(A) That the Clarks Hill-Russell Authority of the State of South Carolina is the designated agency of the State to negotiate agreements, accords, or contracts on behalf of and in the name of the State with the United States and with agencies, departments, or commissions thereof, relating to the development of the Savannah River and the development of any or all of the streams connected to or flowing into such river and is also the designated agency of the State to receive, hold title, and to manage any lands in the Clarks Hill Project Area in McCormick County acquired by release as surplus land, pursuant to Section 13-9-30 of the 1976 Code.

(B) That the United States of America (U. S. Army Corps of Engineers) has proposed to declare approximately three thousand acres of land located in the Clarks Hill Project Area in McCormick County, located on Savannah River, Little River, and Buffalo Creek, as surplus land and to transfer the land to the General Services Administration of the United States of America for disposal.

(C) That the Clarks Hill-Russell Authority has proposed to acquire the lands referred to on behalf of the State for the purpose of multipurpose development.

(D) That it is necessary, for the purpose of effectuating the negotiations with the General Services Administration and for the purpose of conveying title, to designate some person to enter into negotiations with the General Services Administration and to execute such documents as may be reasonably necessary to effectuate the conveyance of the land from the General Services Administration to the Clarks Hill-Russell Authority on behalf of the State.

(E) That John A. McAllister is the current chairman of the Clarks Hill-Russell Authority and that he as chairman and his successors are designated to negotiate and sign documents as necessary.

Chairman authorized to enter into negotiations

SECTION 2. John A. McAllister, Chairman of the Clarks HillRussell Authority of South Carolina, and his successors in office, are authorized on behalf of the State to enter into negotiations with the General Services Administration of the United States of America and to execute, in his capacity as Chairman of the Authority, and on behalf of the State, the documents as may be reasonably necessary to effectuate the conveyance of title from the United States of America to the Clarks Hill-Russell Authority of South Carolina, for the three thousand acre, more or less, tract of land to which reference is made. No documents may be executed by John A. McAllister, Chairman of the Authority, or his successors in office, which shall monetarily obligate the State or any of its political subdivisions without the approval of the State Budget and Control Board.

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
