A JOINT RESOLUTION PERMITTING CHILDREN ELIGIBLE TO ATTEND SCHOOL WHO RESIDE IN A DEFINED AREA OF LEXINGTON COUNTY BORDERING THE BOUNDARY LINE OF LEXINGTON COUNTY SCHOOL DISTRICTS ONE AND THREE TO ATTEND SCHOOL IN EITHER DISTRICT FOR SCHOOL YEAR 1984-85 ONLY, AND TO PROVIDE THAT THE DISTRICT IN WHICH A CHILD ATTENDS SCHOOL SHALL RECEIVE FUNDS ALLOCATED PURSUANT TO THE EDUCATION FINANCE ACT AND TO PROHIBIT EITHER DISTRICT FROM REQUIRING REIMBURSEMENT FOR TUITION FOR THE CHILDREN AND TO PROVIDE THAT A COMMITTEE MUST BE APPOINTED TO MAKE A RECOMMENDATION TO THE LEXINGTON COUNTY LEGISLATIVE DELEGATION BY MARCH 1, 1985.

Be it enacted by the General Assembly of the State of South Carolina:

Lexington County School districts - eligibility for attending

SECTION 1. Notwithstanding the provisions of Section 59-63-30 of the 1976 Code or any other law, and for the school year 1984-85 only, children residing in the area described in Section 2 of this act who are eligible to attend school may choose to attend the schools of either Lexington County School District One or Lexington County School District Three. Notwithstanding any other provision of law, the school district in which a child attends school shall receive those funds allocated to districts pursuant to Act 163 of 1977 (Education Finance Act). No tuition reimbursement may be required by either school district for children attending district schools pursuant to this act.

Applicability of act

SECTION 2. The provisions of this act are applicable in the area described as following: Beginning at Horse Creek Bridge on Highway 378, follow the 360 foot contour lines of Lake Murray until the Pleasure Island subdivision is completely encompassed, thence along the school district boundary to the point where Highway 378 intersects the school district boundary line near Koon's Garage, thence westerly along Highway 378 to the point of origin. The area defined by this description includes, but is not limited to, the subdivisions of Driftwood Points, Oswald Park Estates, Lake Murray Family Campground, and Pleasure Island. Committee

SECTION 3. A committee must be appointed composed of two members appointed by the trustees of Lexington County School District No. 1, two members appointed by the trustees of Lexington County School District No. 3, and three members appointed by the State Department of Education. This committee shall, after consideration of the best interests of the children in the area defined in Section 2 of this act and the school districts affected as a whole, including the tax base of the districts and the customs and practices of the districts, make a recommendation to the Lexington County Legislative Delegation prior to March 1, 1985.
