AN ACT TO ABOLISH THE PICKENS COUNTY BOARD OF EDUCATION AND THE OFFICE OF THE PICKENS COUNTY SUPERINTENDENT OF EDUCATION AND TO DEVOLVE THE RESPECTIVE DUTIES UPON THE TRUSTEES FOR THE PICKENS COUNTY SCHOOL DISTRICT; TO AMEND ACT 811 OF 1978, AS AMENDED, RELATING TO THE CREATION OF THE SINKING FUND COMMISSION FOR THE SCHOOL DISTRICT OF PICKENS COUNTY, SO AS TO SUBSTITUTE THE COUNTY ADMINISTRATOR FOR THE SUPERINTENDENT OF EDUCATION AS A MEMBER OF THE COMMISSION; TO PROVIDE THAT THE EMPLOYMENT CONTRACT OF THE SUPERINTENDENT OF EDUCATION APPOINTED BY THE BOARD OF TRUSTEES OF PICKENS COUNTY MUST BE FOR A PERIOD NO LONGER THAN TWO YEARS; TO PROVIDE THAT THE SALARY OF THE SUPERINTENDENT OF EDUCATION APPOINTED BY THE BOARD OF TRUSTEES OF PICKENS COUNTY MAY NOT EXCEED THE SALARY OF THE STATE SUPERINTENDENT OF EDUCATION; AND TO PROVIDE THAT EACH MEMBER OF THE BOARD OF TRUSTEES OF PICKENS COUNTY SHALL RECEIVE FIFTY DOLLARS PER MONTH TO REIMBURSE THEM FOR THEIR EXPENSES INCURRED IN THE PERFORMANCE OF THEIR OFFICIAL DUTIES.

Be it enacted by the General Assembly of the State of South Carolina:

Board and superintendent of education abolished

SECTION 1. The Pickens County Board of Education and the office of the Pickens County Superintendent of Education is abolished at midnight on June 30, 1985. Upon abolition, their respective duties shall devolve upon the trustees for the Pickens County School District. After June 30, 1985, the Pickens County Treasurer shall pay any proper claim approved by a majority of the trustees of the school district of Pickens County, provided sufficient funds are on deposit in the district's account.

Composition of sinking fund changed

SECTION 2. Section 1 of Act 811 of 1978 is amended to read:

"Section 1. There is created the Sinking Fund Commission (commission) for the School District of Pickens County (district) to consist of the Pickens County Auditor, Treasurer, and Administrator. The commission shall establish and administer a sinking fund to be used for the retirement of the bonded indebtedness of the district. It shall annually recommend to the auditor a tax levy sufficient to service all outstanding bonds of the district."

Employment contract of superintendent

SECTION 3. The employment contract of the superintendent of education appointed by the board of trustees of Pickens County must be for a period no longer than two years.

Salary

SECTION 4. The salary of the superintendent of education appointed by the board of trustees of Pickens County may not exceed the salary of the State Superintendent of Education. Reimbursement

SECTION 5. Each elected member of the board of trustees of Pickens County shall receive fifty dollars per month to reimburse them for their expenses incurred in the performance of their official duties.

Time effective

SECTION 6. This act shall take effect upon approval by the Governor.
