AN ACT TO AMEND SECTION 13-3-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE MEMBERSHIP OF THE STATE DEVELOPMENT BOARD, SO AS TO PROVIDE THAT MEMBERS AT LARGE BE RESTRICTED TO SERVING TWO CONSECUTIVE TERMS INSTEAD OF RESTRICTING MEMBERS TO TWO TERMS.
Be it enacted by the General Assembly of the State of South Carolina:
Membership - State Development Board
SECTION 1. Section 13-3-40 of the 1976 Code, as last amended by Act 123 of 1979, is further amended to read:
"Section 13-3-40. The Department is governed by a Board consisting of nineteen citizens of the State appointed by the Governor upon the advice and consent of the Senate. One member must be appointed from each of the sixteen judicial circuits and three must be appointed from the State at large. The Governor shall appoint one of the at-large members to serve as chairman. The terms of the members are for a period of five years and until their successors are appointed and qualify. After the service of two consecutive terms an at-large member is not eligible for reappointment. The Governor in making subsequent appointments shall give due consideration to the rotation of appointees among the counties of each judicial circuit. Any officers considered necessary by the Board in addition to the chairman must be selected by the Board to serve for such terms as the Board may designate. Vacancies must be filled in the manner of the original appointments for the unexpired portions of the terms only."
Time effective
SECTION 2. This act shall take effect upon approval by the Governor.
