AN ACT TO AMEND SECTION 40-43-50, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO QUALIFICATIONS OF APPLICANTS FOR EXAMINATION AS REGISTERED PHARMACISTS, SO AS TO CHANGE THE TERM "REGISTERED PHARMACIST" TO "LICENSED PHARMACIST", DELETE THE PROVISION THAT THE STATE BOARD OF PHARMACY, PRIOR TO PROMULGATION OF CERTAIN REGULATIONS, MAY IN ITS DISCRETION ACCEPT CREDIT FOR ANY INTERNSHIP COMPLETED PRIOR TO APRIL 1, 1980, IN A PROGRAM NOT PREVIOUSLY RECOGNIZED BY THE BOARD, AND PROVIDE A PROCEDURE FOR LICENSURE OF AN APPLICANT WHO IS A GRADUATE FROM A SCHOOL, COLLEGE, OR DEPARTMENT OF PHARMACY OF A UNIVERSITY LOCATED OUTSIDE THE UNITED STATES WHICH HAS NOT BEEN RECOGNIZED BY THE STATE BOARD OF PHARMACY AND WHO IS OTHERWISE QUALIFIED TO APPLY FOR A LICENSE TO PRACTICE PHARMACY IN THIS STATE.

Be it enacted by the General Assembly of the State of South Carolina:

Requirement for applicants

SECTION 1. Section 40-43-50 of the 1976 Code, as last amended by Act 120 of 1981, is further amended to read:

"Section 40-43-50. An applicant for examination as a licensed pharmacist must be a graduate from a school, college, or department of pharmacy of a university which is recognized by the board, the recognition to be established by the board on the basis of uniform and reasonable standards of educational requirements to be observed by schools, colleges, or departments of pharmacy of universities.

Applicants shall furnish proof of attendance at the school, college, or department of pharmacy from which the applicant is a graduate. All applicants for licensure by examination shall also obtain practical experience in the practice of pharmacy under terms and conditions as the board determines. The board shall establish standards for internship or any other program necessary to qualify an applicant for the licensure examination and shall also determine the necessary qualifications of any preceptor used in any internship or other program. The standards and qualifications must be established by regulations promulgated pursuant to Act 176 of 1977.

Any applicant who is a graduate from a school, college, or department of pharmacy of a university located outside the United States which has not been recognized by the board and who is otherwise qualified to apply for a license to practice pharmacy in this State may be considered to have satisfied the graduation requirements of this section by verification to the board of his academic record and his graduation and by meeting any other requirements the board may establish. The board may require the applicant described in this paragraph to pass successfully an examination or examinations given or approved by the board to establish proficiency in English and equivalency of education of this applicant with qualified graduates from a school, college, or department of pharmacy of a university recognized by the board as a prerequisite to taking the examination for licensure.

Any physician, licensed to practice medicine in this State, must also be allowed to take the examination for the practice of pharmacy, as provided herein."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
